JAMMU, May 2: In the much publicized Public Interest Litigation (PIL) wherein bank was imposed on extraction of minerals from River Tawi and constructions on its banks, Division Bench of State High Court comprising Justice Alok Aradhe and Justice Tashi Rabstan today directed Divisional Commissioner Jammu to appear in person on next date of hearing.
When the matter came up for hearing, Senior Advocate Sunil Sethi submitted that vide order dated 17.11.2016 Division Bench had directed the State to identify all constructions coming and falling on either side of River Tawi, from its fringe line, either Government or individual and prepare a list of such construction so that same are removed.
“The list of all such constructions had to be prepared within 15 days and thereafter the process for removing and rehabilitation had to be undertaken within a month’s time but the direction has not been complied with”, he added.
Upon this, Division Bench directed Divisional Commi-ssioner Jammu to remain present in the court on May 9 to apprise the court with regard to the status of implementation of direction.
“This court by an order dated 28.12.2016 had directed the constitution of the committee comprising A K Koul, the then Registrar General as well as Parvinder Singh, DIG (Retd.) to inspect the area(s) of the subject matter of instant PILs as well as for submission of fortnightly reports to the Registrar Judicial. Since A K Koul has already demitted the office of Registrar General and is not available, therefore, fresh committee to oversee the direction and to ensure the implementation of the orders issued by this court from time to time, is required to be constituted”, the DB said.
Accordingly, DB issued directions for constitution of the fresh committee comprising Ashok Kumar Sharma, retired District Judge, Parvinder Singh, retired DIG and Advocate Sudershan Sharma.
