JAMMU, May 2: In a contempt petition filed by a specially abled lawyer Suraj Singh, who has been denied Government accommodation, Division Bench of the State High Court comprising Justice Alok Aradhe and Justice Janak Raj Kotwal today issued notice to Director Estates in the first instance.
When the contempt petition came up for hearing, Advocates S C Gupta and Sheikh Shakeel Ahmed appearing for specially abled lawyer submitted that Division Bench on March 6, 2017 had issued directions to the Minister for Estates to take a decision in the matter in view of the interpretation given to Regulation 4(e) of J&K Estates Department (Allotment of Govt. Accommodation) Regulations, 2004 in respect of the entitlement of Advocate Suraj Singh for accommodation within a period of 04 weeks.
“Despite expiry of four weeks the Minister for Estates has miserably failed to comply with the directions of the Division Bench as till date the order of allotment has not been issued in favour of the petitioner”, they said, adding “the petitioner is in litigation for the Government accommodation since 2011 and has already won two rounds of litigation”.
After considering the submissions of counsels for the petitioner, Division Bench issued notice to Director Estates in the first instance returnable within four weeks. However, the Division Bench deferred notice to Mehbooba Mufti, Minister for Estates at this stage.
