DB directive to State on enquiries

JAMMU, Sept 15: Division Bench of the State High Court comprising Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal today directed the Government to take appropriate decision within six weeks with regard to the filling up of the vacancies for J&K State Accountability Commission and also for finalization of 147 departmental enquiries.
When the much publicized PIL came up for hearing, Advocate SS Ahmed with Advocates Irfaan Khan and Rahul Raina invited the attention of the Division Bench to the latest status report filed by the GAD wherein it was submitted that the Department of Law, Justice and Parliamentary Affairs has already initiated the process for filling up of vacant positions in State Accountability Commission.
He further submitted that names of some of the probables have already been empanelled and the State Government has only to finalize the panel so prepared. He further submitted the highest anti-graft body of the State is lying defunct for the last more than one year and appropriate directions are warranted to the Law Department to take a final call in the matter.
Senior Advocate Sunil Sethi appearing for SAC also vociferously argued for issuing a time bound direction to the State to take a final call with regard to the filling up of vacancies for SAC.
Advocate Ahmed also invited the attention of the Division Bench towards non-finalization of 147 Departmental Enquiries.
After considering the submissions of Advocate S S Ahmed appearing for the PIL, Senior Advocate Sunil Sethi for SAC, Ehsan Mirza, AAG for the State, Deputy AG PS Chandel for Law Department and Ahtsham Bhat for GAD, Division Bench directed State to take appropriate decision in the matter within six weeks.
