Srinagar, May 28: The Jammu and Kashmir High Court today directed the State Government to file the status report with regard to the amendment of provisions of Prevention of Corruption Act before June 10.
A Division Bench of the High Court comprising Chief Justice MM Kumar and Justice MH Attar after hearing amicus curie and senior advocate Bashir Ahmad Bashir directed the Government to file status report with regard to the suggestions made by this court in it earlier order over the amendment in the provisions of the Prevention of Corruption Act.
The court in July 2013 had made certain suggestions regarding the amendments in the Act and had directed the Government to implement these suggestions for making the PC Act more effective and comprehensive.
The court in December, 2013 had considered two issues one was grant of benefits to the needy girls numbering 3,73086 which were identified by Social Welfare Department and following the court direction for upliftment of these poor girls a scheme was formulated by the Government and other issued was amendment in prevention of Corruption Act.
The issue with regard to betterment of poor girls was challenged before Supreme Court by way of SLP which came to be dismissed with the direction that State Government to give effect to the directions given by the High Court for Comprehensive Scheme for betterment of the girls in accordance with Article 21 of the Constitution.
The Supreme Court while dismissing the SLP observed “we are happy to note that the State Government is doing a laudable work for improvement of the fate of destitute girls. Over and above, the High Court has also given some directions. We find no illegality in those directions.”
The bench observed that no response with regard to amendment in the provisions of prevention of corruption act in the light of the suggestions made by this court in terms of earlier order has been filed and directed the respondents through Javed Ahmad Kawoosa (senior AAG) for filing the same if the issue has not been stayed by Supreme Court.
