Court rejects pre-arrest bail in rape case

JAMMU, July 27: Principal Sessions Judge Rajouri Shahzad Azeem today rejected the pre-arrest bail application of one Javed Ahmad in a rape case.
“Once there is statutory prohibition, which completely bars the moving of pre arrest bail in terms of Section 497-A CrPC in respect of offence under Section 376 RPC, the onerous duty is cast upon the State to raise such preliminary objection at the outset in order to discharge its statutory duty and also to save the precious time of the court as well”, Principal Sessions Judge said.
“It is hoped that in future the State would come forward to assist the court in proper manner so that complete justice is rendered as per law”, the Principal Sessions Judge added.
