Court rejects bail of Saderkoot massacre accused

Srinagar, Aug 22: A local court here rejected bail application of an accused in case of Saderkoot massacre in 1996 in which at least six persons were killed.
The case of the prosecution was that on 05/10/1996, complainant along with others of Saderkoot Bala stating verbally that few persons boarded on truck fired indiscriminately at Sadderkoot due to which Hilal Ahmad Dar, Rafiqa Bano, Bashir Ahmad Dar, etc got injured and Saif Din Dar, Ghulam Rasool Dar, Ghulam Nabi Dar, Hajra, Abdul Rashid Dar and Abdul Salam Dar died on spot and upon the receipt of the complaint FIR No.125/1996 U/s 302, 307, 325, 341, 34 of RPC & Section 7/27 Arms Act was lodged and the investigation was undertaken.
The court of Principal Sessions Judge Bandipora presided by Amit Sharma on the basis of reasons and discussions made by the counsel for the parties arrived at the conclusion that the personal liberty of the accused-Mohammad Ayoub Dar can be curtailed in the interest of society at large as well as taking into consideration the gravity of the charge against him.
“Hence the bail application moved by the accused person is rejected and be made part of the main file. The case law submitted by the learned counsel of the applicant is not applicable in the given facts and circumstances of the case”, the Court concluded.
The Court , on perusal of the material evidence of the case, said the accused- was very much present on the date of occurrence in Saderkoot Bala and was not appointed in the Army and was working with the supreme commander Abdul Rashid Billa of Hizbul Mujadeen, a banned militant organization.
“That the material witnesses which have been produced before this court are none other than the persons whose family members were killed in front of them by these accused persons along with other co-accused. That due to this indiscriminate firing by these accused persons seven persons were killed for only a single fault that they had cast their votes in the favour of rival party and due to this mass level bloodshed the whole village is crying for the justice in this case from last almost 26 years”, read the judgment of the court.
Court said that neither the deceased persons were militants nor related to any militant organization but their only fault was that they were related to the National conference party and in the said year there was an Assembly election.
Court said the family members of the said persons were mercilessly killed in front of them without any of their fault and the only fault which has been gathered from the statement of the witnesses that they cast their mandate in favour of the opposite party during the Assembly elections of 1996. So the active role played by the accused person is quite apparent from this conduct of bloodshed in the village of Saderkoot Bala.
