JAMMU, Aug 30: In a complaint filed by Nawdeep Sharma, resident of Sainik Colony, the Special Municipal Mobile Magistrate Jammu, V S Bhou today directed the SSP Jammu to register FIR against SHO Police Station Trikuta Nagar Inspector Sameer Jeelani and four PSOs.
In the complaint, it has been submitted that on August 21 when complainant was withdrawing money from the ATM of PNB at Bahu Plaza along with his cousin he was called by SHO, who then started using abusive and un-parliamentary language against the complainant.
When the complainant objected to it and asked for the reasons of mis-behaving and using filthy language in public place in-front of many people, the SHO started assaulting the complainant without any reason.
In the meanwhile, the PSOs of the SHO also started beating and thrashing the complainant mercilessly. As the people started gathering at the spot, SHO along with other police officials took the complainant to Police Station Trikuta Nagar where he was again beaten up with sticks, iron-rod and rubber sole.
During the period of detention the complainant was threatened by all the police officials not to utter a single word about the whole episode and if at all he choose to disclose the same to any one, he will be implicated in some frivolous cases. After the intervention of local public and relatives of the complainant and realizing the deteriorating condition of the complainant, SHO released him after two hours of illegal detention.
The complainant was taken to Government Hospital Gandhi Nagar for treatment where the MLC case was registered. The complainant prayed before the Court to pass the directions to SSP Jammu to conduct an investigation in respect of the allegations leveled against the SHO and others.
After hearing Advocate J P Nanda appearing for the petitioner, Special Municipal Mobile Magistrate observed, “thorough investigation into allegations is warranted as such the complaint is forwarded to SSP Jammu to register FIR against the accused because cognizable case has been made out against them”.
“Periodical reports of investigation be communicated to this Court by SSP Jammu and first action taken report be filed on September 12, 2012”, the Court said.
