Court directs SSP to protect 8 kanals land at Karan Nagar

JAMMU, May 12: 1st Additional Sessions Judge Jammu M A Chowdhary today directed SSP Jammu to preserve and protect 8 kanals of land at Karan Nagar from alleged land grabbers and trespassers.
After hearing Advocate Tarun Sharma, court observed, “applicant Satish Kumar, one of the defendant, has moved this application under Section 151 of CPC for preservation of suit property asserting that the suit titled Tirath Ram Amla & Ors Vs Ashok Kumar & Ors is subjudice and next date fixed in the matter is 30.05.2017”.
“The suit had initially been pending before the High Court and somewhere in 1995, same was assigned to this court. In sheer violation of the order passed by the High court, some of the plantiffs and defendants having been hand in gloves with some goons had vandalized the suit property of Kashmir Traders Corporation situated at Srinagar and are trying their best to encroach upon the suit property measuring 08 kanals situated at Karan Nagar Jammu, which is still attached with the High Court”, the court said, adding “one Vikas Dutt had executed agreements to self in favour of one Kulbir Singh and the property is being encroached and vandalized in sheer violation of the order dated 04.08.1993 passed by the High Court”.
The court issued notice to the parties to the suit in this application as well as in the application for interim relief. However, in view of the emergent nature of the matter, it was observed that the suit property, being custodial legis of the trial court, was required to be protected so that the rights of none of the parties are affected.
Accordingly, the court directed  SSP Jammu to ensure that the suit property at Jammu is preserved and protected and not interfered in any manner till disposal of the suit.
