Court denies bail in rape case

JAMMU, Oct 23: Principal Sessions Judge Reasi Kamlesh Pandit today rejected the bail application of one Hem Raj, son of Sher Singh of Channa village of Reasi district, who was allegedly involved in rape with a minor girl.
After hearing both the sides, court observed, “the prosecutrix because of the heinous act of the accused got pregnant and delivered a baby and there is nothing on record to show that the accused had made honest promise to the prosecutrix to solemnize the marriage with her”.
“The fact is that accused was already married and has also children. It has been further pleaded that evidence on record is substantial against the accused person for his connection with the commission of the offence committed by him and the accused person does not deserve to be bailed out”, the court further observed.
The court said, “offence of rape is not against an individual but a crime which destroys the basic equilibrium of the society. The incident of rape creates an incredible dent in the fabric of the social milieu and society as a whole is compelled to suffer”, adding “from the record available it appears that there are reasonable grounds for believing that the accusation against the accused are prima facie true and thus attracts statutory bar under Section 497- CrPC”.
Accordingly, court rejected the bail application.
