Court denies bail to alleged rapist

JAMMU, Dec 5: Principal Sessions Judge Kathua, Vinod Chatterji Koul today rejected the bail application of Devinder Kumar, son of Balkar Chand of Kathua, who was allegedly involved in rape with married woman on October 8, 2014.
After hearing both the sides, Principal Sessions Judge observed, “any statement of sexual assault is an extremely humiliating experience for a woman and until she is a victim of sex crime, she would not blame anyone but the real culprit”.
“While granting bail, the court has to keep in mind the nature of accusations, the nature of evidence in support thereof, the severity of the punishment which conviction will entail, the character of the accused, circumstances which are peculiar to the accused, reasonable possibility of securing the presence of the accused at the trial, reasonable apprehension of the witnesses being tampered with the larger interests of the public/State and other similar considerations”, the court said.
With these observations, court rejected the bail application of the accused.
