Court ceases account head of CMO, BMO

POONCH, May 21: Principal  District Judge Poonch, Tahir Khurshid Raina today ceased the account  head of the  salary of the  Chief Medical Officer Poonch and  Block Medical  Officer  Mandi  in an execution petition  filed by the complainant who is struggling  in the court for justice  for last  10  years.
The complainant who hails from Mandi tehsil is an extremely poor man who was given a wrong injection by a Pharmacist of Health Department at Mandi in 2005, which resulted into damage to his right hand which started limping.
This poor man who was meeting his needs by labouring became helpless. He approached the District Court Poonch in 2006 for grant of compensation  from Heath Department on account of wrong medical treatment.
After a long legal battle of seven years, the court awarded him compensation in 2013 amounting to Rs 3 lakh with interest at the rate of seven percent  to be paid by  the respondents including  Chief Medical Officer Poonch and Block Medical Officer Mandi.
In 2014, complainant filed petition for execution of the judgment and decree passed in his favour in 2013. For the  last two years the Health Department didn’t  respond positively  to  the  concern  of the  court. Today,  when  the case was taken up, court  after hearing counsel for the  parties, observed that Health Department has been  simply  changing the  counsels or producing the  communications  and  what was required  to be  done  has not been done by them so  far.
Principal District Judge Poonch Tahir  Khurshid  Raina,  in his detailed order, observed  that   moorings  of judicial  institution  depends upon the  faith of a common  man in it and  this  court will  not leave  any stone unturned in keeping this faith intact in the judiciary.
“The complainant is an extremely poor  man who is yearning for justice for last 10 years. He will lose his faith in this institution if court will remain mute spectator  to such a lackadaisical  approach  of  the  Govt”, Principal District Judge said, adding “keeping in view  the conduct of judgment debtors  which   includes CMO Poonch and BMO Mandi, stringent  measures  have  become inevitable”.
Accordingly, court directed that account head of salary of CMO Poonch and  BMO Mandi  be  ceased. Treasury Officer of Poonch and Mandi  have been directed to show compliance to the order of the court  and their salary should not be released even from any other head.
