JAMMU, Oct 15: Principal Sessions Judge Kathua, M K Hanjura today awarded 10 years rigorous imprisonment to Ravi Kumar alias Ravi Kant, resident of Dharamkot, Billawar, who had committed rape with a minor girl.
According to the police case, on May 12, 2009, the prosecutrix aged 11 years went to the house of the accused Ravi Kumar, son of Bansi Lal to fetch water from the tank. The accused caught hold of the prosecutrix and took her forcibly in the kitchen and committed rape with her. Accordingly, a case was registered and after completion of investigation challan was presented in the court of law.
After hearing Public Prosecutor Ravi Kumar Gupta appearing for the State whereas Advocate T N Gupta for the accused, Principal Sessions Judge observed, “this crime falls within the purview of Clause (6) of definition of rape as provided under Section 375 RPC, Clause (e) of Section 376 RPC provides that whosoever commit rape on a woman when she is under 12 years of age, shall be punished with rigorous imprisonment for a term which shall not be less that 10 years but which may be for life and shall also be liable to fine provided that the Court may, for adequate and special reasons to be mentioned in the judgment, impose a sentence of imprisonment of either description for terms of less than 10 years”.
“Such a crime has to be dealt with a strong hand. Rape of a minor girl is the worst form of oppression. It is heinous offence. A sexual assault brings humiliation, feeling of disgust embarrassment, sense of shame, trauma and a life long emotional scar to a victim. It is tough for a victim of rape to adjust in social set-up. It causes serious psychological as well as physical harm”, the Court said, adding “a murder destroys the physical body of the victim but a rapist degrades the very soul of helpless family”.
“The court owes a great responsibility while trying an incident of rape. In the instant case, a girl student, aged 11 years, had been sexually assaulted by the accused”, Principal Sessions Judge observed and awarded 10 years rigorous imprisonment to accused Ravi Kumar.
