Court acquits husband in abetment to suicide case

JAMMU, Aug 12: Principal Sessions Judge Udhampur, A K Koul has acquitted Keshav Verma and Ravi Kumar, sons of Jagdish Chander Verma of the charges of abetting the suicide of Mamta Devi as right from the investigation stage the case was found handled in a very casual manner although a serious effort was required to reach at the truth.
According to the prosecution case, a young woman namely Mamta Devi was hospitalized in Government Medical College on May 5, 2005 on account of having received burn injuries. In the meantime minor daughter of deceased Bhagisha was examined by police and she narrated that accused assaulted the deceased with a stick and thereafter poured kerosene  and acid on her body and put her on fire.
On the basis of this statement, case under Section 302/120-B/498-A RPC was registered and after completion of the investigation challan was presented.
After hearing both the sides, Principal Sessions Judge Kathua, A K Koul observed, “none   of the witnesses has stated that deceased  and the accused used to pick up quarrel frequently or there was any disharmony between them”, adding “this case suffers from serious infirmities. Right from the investigation stage the case has been handled in a very casual manner although a serious effort was required to reach at the truth. Even after the conclusion of the trial it is not known as to why deceased committed suicide or if it was a case of murder who killed her. The facts put before the court are not clear as to what actually must have happened”.
“Most of the witnesses have been withheld for the reasons not known although the trial has taken a very long time to conclude. The prosecution has failed to bring home the guilt against the accused. As such there is no option but to dismiss the case”, court said and acquitted the accused of the charges.
