JAMMU, Mar 26: Principal Sessions Judge Kathua, A K Koul today acquitted a police constable Mangal Dev, son of Mohinder Nath of R S Pura, who was facing trial in a case of murderous attack on Selection Grade Constable, as prosecution failed to prove its case.
After hearing both the sides, Principal Sessions Judge Kathua observed, “the prosecution case suffers from serious infirmities which cast a cloud on the genesis of the prosecution version”, adding “the involvement of the accused in the commission of the alleged crime is seriously doubtful and the benefit of that doubt has to be extended to the accused”.
With these observations, the Court dismissed the prosecution case for want of sufficient evidence and acquitted the accused while being given the benefit of doubt.
