Contradictory statement of prosecutrix leads to discharge of rape accused

JAMMU, Aug 7: Presiding Officer Fast Track Court, Sanjeev Gupta has discharged one Balbir Kumar at the stage of framing of charge in a rape case as the prosecutrix made contradictory statements.
According to the police case, on March 21, 2012 prosecutrix lodged a written report at Police Station Arnia with the allegations that about 12 years back while working in a gun factory at Satwari she got acquainted with the accused who was also used to work there. The accused fell in love with her and promised to marry her. But the marriage could not be solemnized because of prosecutrix and accused belonging to different castes.
Later, the accused kept her in a rented house at Miran Sahib and repeatedly committed sexual intercourse with her against on the pretext that he will try to enter into wedlock with her.
After hearing Advocate BB Kotwal for the accused person whereas Additional Public Prosecutor for the State, Presiding Officer, Fast Track Court, Sanjeev Gupta observed, “the statement of prosecutrix in FIR is contradictory to one recorded under Section 164-A. Moreover, she was a consenting party”, adding “the charges against the accused are groundless and there is no sufficient ground to proceed the accused with regard to the commission of offence”.
Accordingly, court dismissed the prosecution case and discharged the accused at the time of framing charges.
