Contempt against 3 PDD officials

Srinagar, Sept 21: The High Court today initiated contempt proceedings against three top officials of the Power Development Department (PDD) for issuing the consideration order against a Court judgment.
Hearing a contempt petition filed by one Abdul Aziz Shah (Junior Engineer in PDD) Justice Magrey held that the case for contempt against Principal Secretary to Government Power Development Department (Sandeep Naik), Development Commissioner Power (Gul Ayaz Sheikh) and Commissioner/ Secretary to Government Power Development Department (Dheeraj Gupta) is made out as such the Court has no option than to proceed against these officials.
“Registry to frame Rule against the Respondents, who shall submit the reply to show cause as to why they shall not be punished for contempt of the court within four weeks”, Justice Magrey directed.
Shah submitted that the similarly situated Junior Engineers had challenged the Government and the court while deciding the petition in terms of judgment passed way back in the year 2011 set aside the Government order under challenge as such the rejection of claim of Shah is based on non-existent order.
It is further added that all those Junior Engineers, who are similarly situated with him have been given the benefit of circular dated September 9, 2004 and the officials have joined the issues only in case of petitioner Shah, that too in violation of the judgment passed by the court.
