JAMMU, Aug 30: Division Bench of Chief Justice Gita Mittal and Justice Rashid Ali Dar has directed State to file a status report regarding possibility of creating a dedicated authority for the welfare of transgenders.
Earlier, DB while considering the status report dated June 29, 2019 filed by Social Welfare and other departments, observed, “the report is hopelessly deficient and only discloses instructions and communications inter se the departments. For instance, we are not informed as to the steps taken to ensure school and college admissions to the transgender community”.
DB directed the State Government to submit a status report which should set out not only directions and instructions, but the steps actually taken and the position on the ground with regard to ensuring and enabling an inclusive environment to the transgenders in the State.
It was pointed out by Moksha Kazmi, amicus curiae that in several other States Governments have constituted Transgender Welfare Boards. However, there is no such Board or Authority in the State of J&K. “Such a Board if constituted would go a long way in mitigating the suffering and difficulties of the transgender community”, she added.
Upon this, DB directed Chief Secretary of the State to examine this aspect of the matter and, if possible, designate/constitute a dedicated authority for the welfare of transgenders. “Such authority would function as a nodal authority and will go a long way in mitigating the woes of the transgenders”, the DB added.
