JAMMU, Feb 25: In the much publicized Kakarayal forest terror attack case, Special Judge NIA Subash C Gupta today framed charges against Mohd Iqbal Rather and Riyaz Ahmed Nengroo, supporters of JeM.
According to the NIA case, the accused persons were in constant touch with leadership/ handlers based and operating from Pakistan through social media and in pursuance of a conspiracy hatched in Pakistan on September 12, 2018 Mohd Iqbal Rather and Ashiq Ahmed Nengroo received three unknown Pakistan trained terrorists equipped with heavy arms, ammunition, explosive and other war like articles of at Bain Bridge on Jammu -Pathankot National Highway.
These terrorists had infiltrated into Indian territory on the intervening night of 11th/12th of September 2018 from International Border and then boarded a truck bearing registration number JK03F-1476, which was however intercepted at Sai Cafeteria near Jajjar Kotli Bridge and accordingly the terrorists started firing.
In the incident, a Guard belonging to Sericulture Department sustained injuries. During the encounter with security forces the terrorists fled towards Kakarayal Forest and on 13.09.2018 they were killed by the security forces.
After hearing both the sides, Special Judge NIA observed, “on deep analysis of the allegations as proved by the investigating officer against the accused, delineated in the charge sheet of NIA filed in terms of Section 173 of Code of Criminal Procedure. I am of the certain view that sufficient grounds are existing for drawing presumption that the accused namely – Mohd Iqbal Rather & Riyaz Ahmed Nengroo, prima facie have committed offences under Sections 307 of RPC, 7/25& 35 Arms Act, 4/5 Explosive Substance, Act, 13,18,19,20,21,38 & 39 UA(P) Act, 6 (1A) of the Indian Wireless Telegraphy Act, 1933 & 14 (c) Foreigner Act read with Section 120-B of RPC”.
Accordingly, charges were framed against them.
