Charges against XEn, wife in Disproportionate Assets case

SRINAGAR, May 8: Special Judge Anti Corruption today framed charges against Executive Engineer (Mechanical ) Abdul Rashid Haji, son of Ghulam Mohammad Haji of Bandipora and his wife Jamsheeda for possession of disproportionate assets.
The case against the Executive Engineer was registered by the Vigilance Organization on September 20, 2006 following complaints regarding disproportionate assets.
During investigation, the Executive Engineer was found to have raised disproportionate assets worth Rs 1.07 crore. He was also found to have purchased 01 kanal 14 marlas of land at Rawalpora with a palatial house on it and flat at Gurgoan Haryana.
At the time of investigation, he was having Rs 43 lakh in his bank account with monthly expenditure of Rs 70,000. During investigation, his wife was also found to have actively assisted him in the concealment of assets raised from ill-gotten money. She was found to have resorted to impersonation and forgery while maintaining the bank account. Consequently, sections 109, 419, 468 RPC were invoked against her.
On July 22, 2008, Vigilance Organization produced challan in the Court of Special Judge Anti-corruption Kashmir against both Executive Engineer and his wife.
The counsel appearing for the accused couple had been pleading that wife of a public servant cannot be held for abetment of her husband in raising the disproportionate assets. However, the Special Judge Anti-corruption upheld the contention of Vigilance Organization and charged the Executive Engineer for possession of disproportionate assets and his wife for abetment.
