CAT refuses to stay suspension of Tehsildar

JAMMU, Feb 3: A Bench of Central Administrative Tribunal (CAT) comprising Judicial Member Rakesh Sagar Jain and Administrative Member Anand Mathur has refused the stay the suspension of Tehsildar Bari-Brahamana.
District Development Commissioner, Samba had placed Tehsildar, Bari Brahmana, Qaiser Mehmood Malik under suspension for dereliction of duty. Pending inquiry into his misconduct the Tehsildar has been attached with DC Samba office.
After hearing AAG Amit Gupta for the UT, the CAT observed, “the applicant has failed to make out a prima facie case in his favour for staying the operation of the impugned order of suspension. Therefore, prayer for grant of interim relief is rejected”.
The CAT admitted the OA for hearing and directed AAG Amit Gupta to file the counter affidavit within four weeks. Thereafter, counsel for the applicant may file the rejoinder affidavit, if any, within two weeks.
