Bail denied to 6 in SI exam scam

JAMMU, Feb 8: Chief Judicial Magistrate Jammu Anjum Ara has rejected the bail applications of Yatin Yadav, Pardeep Kumar Katiyar, Asheesh Yadav, Pawan Kumar, Surender Singh and  Anil Kumar in the much publicized SI recruitment scam.
After hearing Advocates Vivek Gaur, Gaurav Gaur & Nitin Kumar Gupta for the applicants whereas Public Prosecutor Vijay Dogra for the CBI, the CJM observed, “charge sheet has already been presented against the petitioners and other accused persons before the court. Cognizance has already been taken by this court and the case is pending at the stage of arguments on maintainability of charge, therefore, further investigation in terms of Section 173(8) CrPC cannot be a ground for allowing the prayer of petitioners so as to entitle them for grant of compulsive/default bail”.
“Perusal of the charge sheet clearly reveals that further investigation is being conducted in terms of Section 173(8) CrPC and the matter is at the stage of consideration of charge/discharge on the basis of charge sheet already presented by respondent. Therefore, this court is of the opinion that without waiting for further investigation and even a supplementary charge sheet if any, this court can proceed further in the case”, the CJM said.
“The petitioners are not found entitled for grant of statutory/compulsive/default bail as such the petitions are dismissed”, the CJM said.
