Bail denied to 2 employees involved in fraud

JAMMU, Jan 16: Principal Sessions Judge Reasi Kamlesh Pandit today rejected the pre-arrest bail applications of two employees in BDO office Mahore namely Jamal Din and Mohd Ashraf in an alleged fraud case.
The allegations against the accused persons/applicants are that they had diverted the money due to the complainant in lieu of the labour work he had conducted in the year 2017-18 and 2019 in to the account of some unknown person.
On the basis of the complaint, a case under FIR 93/2020 under Sections 420/409/109/506/IPC came to be registered in Police Station Mahore and the initial police investigation prima-facie established the misappropriation of public funds due to be released to the complainant.
While rejecting the bail applications, the court observed, “the accused persons/ applicants are involved in fraud, misuse and misappropriation of public funds for their personal benefit and to the determinant of the claimants”, adding “the involvement of the accused persons in the crime has been prima-facie highlighted by the investigating agency”.
“Therefore in such circumstances anticipatory bail order, if granted prematurely when investigation is still at the stage of inception or its threshold with the strong objections from the investigating agency, it can frustrate the very purpose of the investigation and real culprit may never be brought to the book”, the court said.
