KARGIL, Nov 26: Principal Sessions Judge Kargil, Ashok Kumar Shavan today rejected the bail application of a narcotics smuggler.
The smuggler namely Vijay Kumar Gupta, son of Shiv Kumar of New Plots, Janipur was arrested by Kargil Police on August 13, 2014 along with over 400 grams of charas from his rented accommodation in Balti Bazar. A case under 8/20 NDPSA was registered against him and investigation started.
After hearing Advocates Zahid Hussain and Khadim Hussain for the accused person and Public Prosecutor Kachoo Manzoor Ali, Principal Sessions Judge observed, “the NDPS Act carries very stringent punishment for those who deals with business of narcotics drugs and psychotropic substances”.
“The purpose of legislation to have such strict provision is indeed to prevent drug traffickers or the other unscrupulous elements who deal with such highly abominable business of selling, transporting and possessing those items which have got deleterious effect over the society and in most cases is to provide deadly if is taken in higher quantity”, Principal Sessions Judge observed.
“The application is pre-mature since trial in the case has not commenced much less while seeing to the nature of offence”, the court said, adding “due to fear of punishment, the accused may abscond for which trial of the case may also get frustrated. Further, there is also apprehension that accused may hamper and temper with the prosecution witnesses”.
With these observations, court rejected the bail application.
