JAMMU, Aug 29: Principal Sessions Judge Reasi Kamlesh Pandita has rejected the bail application of Akshit Sharma, son of Davinder Sharma of Nai Basti, Reasi, who was allegedly involved in rape case.
After hearing both the sides, the court observed, “while having minute perusal of the record/report made under Section 173 of the Criminal Procedure Code and also while scanning the complaint as well as statement of the prosecutrix there appears to be reasonable grounds for believing that the accusation against the accused person/applicant is prima-facie true”.
“Therefore, accused at this stage is not entitled to bail. Moreover, the offence of rape is not only an on-slaught on an individual person but on the whole society at large. A sexual assault is considered as one of the most heinous crimes and dastardly acts having social, psychological, physical and emotional repercussions on the life and prospect of a victim as it disturbs the psychological and emotional life of the victim”, the court said.
With these observations, court rejected the bail application.
