Bail denied in attempt to murder case

JAMMU, Sept 22: Judicial Magistrate First Class Bishnah Assma Choudhary has denied bail to the accused who have been booked for the offence of attempt to murder.
The accused are Sunil Sharma, son of Babu Ram of Vijaypur, Sahil Chowdhary, son of Vijay Kumar of Bishnah, Rohit Balowria, son of Gopal Krishan and Akshay Sharma, son of Banarsi Dass of Vijaypur. These persons had opened fire and attached with a sharp edged weapon one Mohd Mansa with an intention to kill him. Resultantly, Mohd Mansa received grievous injuries.
After hearing counsel for the applicants, the court observed, “it needs no reiteration and is well settled proposition of law that while deciding an application for bail the court is to exercise discretion judicially, cautiously and not in a mechanical manner”.
Pointing towards the judgment of the Supreme Court, the Judicial Magistrate observed, “prima facie there is involvement of the petitioners in the offence in question”, adding “one can gauge the impact an alleged incident would have left upon general masses wherein petitioners portrayed complete lawlessness and opened fire in broad daylight to commit the offence”.
“Petitioners who are already on bail in other two FIRs of similar nature have been involved in this occurrence in much less than four months time gap”, the court said, adding “there is no force in the submissions of the counsel for the applicants so as to warrant the court to admit petitioners on bail”. Accordingly, the court rejected the bail application.
