Arguments on SAC cases begin

JAMMU, Nov 23: Argu-ments on State Accountability Commission (SAC) cases began before the Division Bench of the High Court today.
Advocate Pranav Kohli appearing for the Commission stated that SAC enjoys the suo-moto power under the Act. “The Commission has been constituted to curve the menace of corruption in the society and the Act must be read as a whole”, he added.
Advocate Abhinav Sharma appearing for Suman Bhagat, former Health Minister, submitted that Accountability Commission has no powers to initiate suo-moto proceedings and court has already held Regulation 9 framed by the Commission assuming powers to initiate suo-moto proceeding as the ultravires to the Act.
After hearing in length, DB listed the cases on November 26 for further arguments.
It is worthwhile to mention herein that writ petitions were filed by former Deputy Chief Minister Mangat Ram Sharma, former Minister Abdul Majid Wani, former Chairperson Khem Lata Wakhloo, IAS officer Atal Dulloo, the then SHO Sunderbani Jamrodh Singh, Dr Mohd Din, the then Commissioner/ Secretary Animal Husbandry, Dharamveer Koul, the then Executive Engineer PWB (R&B) Udhampur challenging various orders passed by SAC wherein SAC had made recommendations and in some cases had initiated regular inquiries.
