Anticipatory bail denied in rape case

JAMMU, Sept 23: Presiding Officer Fast Track Court Jammu Khalil Choudhary has denied anticipatory bail to one Pahul Sahota, son of Pardeep of Tarn Taran Punjab, who has been booked by the police in a rape case.
“The perusal of the statements recorded under Section 161 & 164 CrPC reveals that there are materials establishing the involvement of the accused Pahul Sahota in the commission of offence”, the court said, adding “the investigation of the case is at initial stage and charge sheet is yet to be produced. Moreover, the accused has not been arrested till date”.
“His custodial interrogation is required for completion of the investigation. So, granting of anticipatory bail to the applicant/accused Sahota will definitely thwart the process of investigation”, the court further said, adding “the accused is involved in heinous offence under Section 376 IPC and in case he is released on anticipatory bail at this stage, there is every apprehension of tempering with the prosecution evidence”.
With these observations, the court rejected the bail plea.
