Abolition of Consumer Courts

Consequent upon abrogation of Art.370 and 35 A , and reorganisation of erstwhile J&K State into two Union Territories ;Union Territory of Jammu and Kashmir, and Union Territory of Ladakh, State Consumer Protection Act stood abolished wef 31st October 2019. Consequently Administration of Lt Governor Jammu and Kashmir has abolished all the State Consumer Fora which had the mandate of addressing the consumer grievances.
It is however painful for the consumers to learn that even after lapse of one month Consumer Redressal Courts at Distt level and State level have not been established , with the result that consumers are at a loss to get their grievances addressed. Even the awards announced by different Consumer Courts are not being implemented by the party against whom award stands announced and consumer feels that he has no where to make an appeal to get the award order implemented. Some consumers are apprehensive that during the period of non existence of Consumer Courts their claims may become time barred. Besides hundreds of consumer related cases were pending before the earlier Consumer Courts and the consumers are desperate to get their grievances addressed quickly.
We the members of Consumer Welfare Association Jammu (Rgd) (CWA) appeal to the Lt. Governor to set up Consumer Courts at the earliest , at all levels as enshrined in the Consumer Protection Act applicable in rest of the country.
