Court stays FIR against ex-JDA VC, others

JAMMU, Mar 26: Principal Sessions Judge Jammu Vinod Chatterji Koul today stayed the order of the Chief Judicial Magistrate (CJM) where direction has been issued for lodging FIR against former VC JDA and others.
The order of the CJM passed in an application moved under Section 156(3) CrPC by Satpal Sharma was challenged in a criminal revision application filed by ex-VC JDA Pawan Singh Rathore (presently Director Agriculture), ex-Director Land Management JDA Devinder Singh Katoch (presently Joint Director, ICDS) and Shruti Bhardwaj, Tehsildar Jammu Development Authority.
In the application before the CJM, it was submitted that on 30.09.2018 the accused persons without showing any reason or rhyme on the part of the complainant or issuing any prior notice to the complainant regarding any illegality or any kind of violation committed by the complainant came along with more than 5 persons and machineries which include bulldozer and started forcibly and illegally demolishing the building raised by the complainant.
After hearing Advocate Adarsh Sharma appearing for the applicants, Principal Sessions Judge stayed the order of the CJM Court.
