HC asks Govt to restore water bodies to original position

SRINAGAR, Aug 5: High Court today directed the Government to take necessary steps to stop encroachments of the Sheksar and Khrwansar water bodies and restore their original position
A Division Bench comprising  Chief Justice M.M. Kumar and Justice Ali Mohammad Magray directed that Sewage Treatment Plants be installed to ensure no wastage is discharged in the lakes or water bodies.
The court was hearing a Public Interest Litigation that sought protection of Sheksar and Khrwansar water bodies at Sumbal in Bandipora district. The PIL also sought these water bodies be restored to their original position by stopping earth filling, construction, dewatering and land plantation.
“We further direct that  no further construction in this area be allowed. Any body found raising construction shall be demolished,” the court said.
The court also directed no court below the High Court should entertain any application with regard to the PIL.
The bench also pulled up the Deputy Commisssioner, Bandipora, M.Y. Zargar for taking the court direction in a casual manner.
The court also asked the Government why encroachments have not been removed on Kacharai despite notices were issued to it.  The court directed the DC to file status report within four weeks.
