JAMMU, Mar 12: J&K Legal Services Authority and Ladakh Legal Services Authority organized National Lok Adalat throughout the UT’s of J&K and Ladakh, today.
In order to have maximum response and settlements between the parties in cases like MACT, matrimonial, cheque bounce cases under NI Act, Money recovery cases, etc., it was advised to organize pre-lokAdalat sittings or pre-counselling sessions (either video or tele-conferencing or physical with social distancing) well before the date of National Lok Adalat so that parties may get one or more chances for entering into negotiation/dialogue with the opposite parties.
Apart this, webinars were organized to sensitize the officers of Legal Services Authorities and Committees, Panel Lawyers and PLVs about the importance of Lok Adalat as a mode for alternate dispute resolution.
Justice Ali Mohammad Magrey, Executive Chairman, J&K Legal Services Authority inaugurated the National LokAdalat in District Court Complex Srinagar. Thereafter, Justice Magrey, inspected different benches of the National Lok Adalat in District Court Complex as well as in the Srinagar Wing of the High Court to have first-hand information about the cases being taken up and disposed of in the National Lok Adalat.
As per the information received from the districts, out of a total number of 89447cases taken up by 155 benches in the day long National Lok Adalat at various courts across the UT of J&K, 72343 cases were disposed off and an amount of Rs 71,43,58,269 was awarded as compensation/settlement amount in civil, criminal, labour disputes, electricity and water bills cases, land acquisition, family matters, cheque dishonor and bank recovery cases. Likewise in Ladakh, a total of 535 cases were taken up by 8 benches and 357 cases were disposed of and an amount of Rs 1,21,63,989 was awarded as compensation/settlement amount in civil, criminal, labour disputes, electricity and water Bills cases, land acquisition, family matters, cheque dishonor and bank recovery cases.
As per the directions of NALSA, Law students were nominated at every district headquarter as well as High Court wings of Jammu and Srinagar to study the impact of the National Lok Adalat. These law students were trained in advance by the NALSA before the Lok Adalat. The proposal to conduct such survey was approved by Justice UU Lalit, Executive Chairman, NALSA on the scheme of Data and Evidence for Justice Reforms (DE JURE).
MK Sharma, Member Secretary, J&K and Ladakh Legal Services Authorities thanked all the participants for their pragmatic approach in settlement of cases in such a large number.
REASI: District Legal Services Authority here organized National Lok Adalat under the insightful directions of Justice Ali Mohammad Magrey, Executive Chairman, JKLSA and radiant guidance and supervision of R.N. Watal, Chairman DLSA Reasi (Principal District and Sessions Judge Reasi). Five Benches were constituted for settling the cases. The Bench Number 1 comprised RN Watal Principal District and Sessions Judge, Rekha Kapoor Nischal, Secretary District Legal Services Authority and Advocate KK Dubey, District Bar Association, Reasi, bench number 2 was consisted of Sudesh Sharma, Chief Judicial Magistrate (Sub-Judge), Arti Devi, Munsiff and Advocate Pawan Khajuria, President Bar Association Reasi, bench number 3 comprised of Manoj Kumar Parihar, Sub-Judge, Sandeep Sen, Munsiff and Advocate Akhil Prashar, President Bar Association, Katra; bench 4 included Mahavir Singh, Munsiff Mahore, Abdul Gani Bhatt, President Bar Association, Mahore and Advocate SS Sahni, Tehsil Mahore and bench number 5 comprised of Priyanka Mahajan, Additional Special Mobile Magistrate Reasi and Rashi Baru, Advocate Bar Association Reasi. A total 3141 cases were taken up for amicable settlement out of which 2595 cases were settled and an amount of 713421 was realized as settlement amount.
DODA: A National Lok Adalat was held today at District Court Complex here under the supervision of Mehmood Ahmed Chowdhary, Additional District and Sessions Judge, Doda. Two benches were constituted for disposal of the cases. The first bench was headed by Mehmood Ahmed Chowdhary, Additional District and Sessions Judge and was assisted by Neena Thakur, Additional Special Mobile Magistrate, while the second bench was headed by Prem Sagar, Chief Judicial Magistrate, Doda and assisted by Sheikh Babar Hussain, District Mobile Magistrate (T). The bench headed by Mehmood Ahmed Chowdhary settled 26 MACT cases and awarded a settlement amount of Rs 84,95,000. In the pre-litigation and post-litigation cases, 13 Civil Cases pending and Recovery cases of different Banks including JK Bank, SBI, PNB and EDB were settled. A total 30 cases were taken up and an amount of Rs 21,57,549 of Bank recovery was settled. A total amount settled in the first bench is Rs 1,06,52,549.
POONCH: A National Lok Adalat was organized in District Courts here. While starting National Lok Adalat, Chairman DLSA Poonch Ashok Kumar Shavan highlighted the positive aspects of Lok Adalat. Various benches were constituted during the National Lok Adalat. First bench was presided over by Ashok Kumar Shavan Chairman DLSA (Principal District and Sessions Judge) Poonch and assisted by Advocate Sanjay Raina Poonch, second bench was presided over by Madan Lal CJM (Chairman TLSC Poonch) and assisted by Wajahat Hussain Kazmi Secretary DLSA Poonch, third bench was presided over by Sarfraz Nawaz Special Mobile Magistrate Poonch and assisted by Dheeraj Kour Advocate, fourth bench was presided over by Tabraiz Ahmed District Mobile Magistrate Poonch and assisted by Advocate Mohd Aslam Chouhan Poonch, fifth bench comprised of Basharat Hussain Additional Deputy Commissioner Poonch and assisted by Jahangir Khan, Tehsildar, sixth bench was presided over by Zaheer Ahmed Kafi Assistant Commissioner Revenue District Poonch and assisted by Anjum Bashir Khan Tehsildar Haveli Poonch, seventh bench was presided over by Abid Hussain Shah Assistant Labour Commissioner Poonch and eighth bench was presided over by Shami Kumar Sharma ARTO Poonch and ninth Bench was presided by Mr. Mushtaq Hussain Executive officer Municipality Poonch. At Surankote, the bench was presided over by Manzoor Ahmed Khan Chairman TLSC Surankote. At Mendhar, the bench was presided over by Shazia Choudhary Chairman TLSC (JMIC) Mendhar and was assisted by Advocate Mohd Rashid Mughal and Advocate Shamim Ahmed. A total of 2325 cases were taken up, out of which 2090 cases were settled. In MACT, 6 cases were settled, 68 criminal cases and 33 civil cases were also decided. Total amount of Rs.7680671 was settled.
RAJOURI: National Lok Adalat was held here at District Court Complex, under the chairmanship of Kalpana Revo Additional Principal District and Sessions Judge, Rajouri. A total of 5 benches were constituted. The first bench was headed by Kalpana Revo Additional Principal District and Sessions Judge, Incharge Principal District and Sessions Judge Rajouri and assisted by Amit Sharma Chief Judicial Magistrate, Rajouri, the second bench was headed by Pawan Sharma Special Mobile Magistrate, Rajouri and assisted by Ghulam Murtaza District Judicial Mobile Magistrate (T), the third bench was headed by Pawan Parihar Additional District Development Commissioner Rajouri and assisted by Aamir Choudhary Block Development Officer Darhal, the fourth bench was headed by Tehsildar Rajouri and assisted by Naib Tehsildar and the fifth bench was headed by the District Social Welfare Officer and assisted by the Tehsil Social Welfare officer. Similar benches were also constituted at Tehsil Level which were headed by the Presiding Officers of the respective Courts. A total 2435 Pre-Litigation and Post-Litigation cases were taken up and 1924 were disposed off. An amount of Rs 1440699 was settled including Rs 89,90,000 as compensation in 25 MACT cases.
RAMBAN: District Legal Services Authority under the guidance and chairmanship of the Principal District and Sessions Judge, Haq Nawaz Zargar, who is also the Chairman District Legal Services Authority, organized National Lok Adalat here in the District Court Complex. A total 1058 cases of different nature were taken up out of which 574 cases were disposed off. A settlement amount of Rs.15490000 was awarded in MACT cases and Rs 8176064 awarded in pre-litigation and other cases. Five benches for settling the referred cases were constituted. The first bench was presided over by the Chairman District Legal Services Authority Ramban, who was assisted by Additional District and Session Judge Fast Track Court Ramban, Surinder Singh, the second bench was presided over by the CJM (Sub Judge), Anjum Ara who was assisted by Munsiff JMIC Ramban, Arusa Choudhary, while 3rd, 4th, and 5th , benches were constituted at Batote, Banihal and Ukhral.
SRINAGAR: The 1st National Lok Adalat was organized by District Legal Services Authority Srinagar and was inaugurated by Justice Ali Mohammad Magrey, Executive Chairman J&K Legal Services Authority and Member NALSA, Judge High Court of J&K and Ladakh. The National Lok Adalat was organized under the chairmanship of Javad Ahmad, Chairman District legal Services Authority (Principal District and Sessions Judge) Srinagar. A total of nine benches were constituted. 78 MACT claims/petitions were taken up in Bench number 1, out of which 25 claims were settled on spot and Rs 1,85,48,000 was awarded as compensation. Besides, the Executive Chairman JK LSA handed over cheques to the tune of Rs 2,07,70,681 on spot in favour of victim families. In bench number 2, a total of 121 bank loan cases were taken up and after hard efforts 41 cases were settled with a settlement amount of Rs 4,96,89,649. A total number of 15,171 cases were taken up for their amicable settlement out of which 14,255 cases were settled. This involves an amount of Rs 3,93,18,681 settled by MACT Srinagar, Rs 4,96,89,649 in banks cases and in addition an amount of Rs 65,46,240 was imposed as fine in traffic cases, out of which Rs 11,12,100 was realized on spot. Moreover an amount of Rs 14, 00,280 was settled in cheque bounce and other compoundable cases.
BUDGAM: The 1st National Lok Adalat was inaugurated by Mohammad Ashraf Malik-Chairman District Legal Services Authority Budgam at District Court Complex, here. The proactive arrangements were put in place and each Court had identified cases for the Lok Adalat beforehand and same were placed before eight different benches constituted by DLSA Budgam for settlement in National Lok Adalat. A total number of 10,000 pre litigation matters were taken up amongst which 9820 were settled. Moreover, an amount of Rs. 2.70 crores has been realized in pre-litigation matters. Furthermore, a total number of 500 post litigation matters were taken up for their amicable settlement, out of which 184 matters were settled. It was given out that a total number of 10,500 matters were taken up for their amicable settlement, out of which 10003 matters were settled. Besides, an amount of Rs. 4.43 crore was realized in toto in the settlement.
BARAMULLA: The District Legal Services Authorities (DLSA) Baramulla today organized National Lok Adalat at District Court Complex, Baramulla under the supervision of Principal District & Sessions Judge Baramulla Mohammad Yousuf Wani. On the occasion, 12 benches were formed across the district during which 2760 cases of different natures were taken up, out of which more than 1800 cases were settled amicably on spot. About 1 crore rupees was also realized as the settlement amount for the said cases.
GANDERBAL: The District Legal Services Authority, Ganderbal under the Chairmanship of Chairperson District Legal Services Authority, Ganderbal, Shazia Tabasum and under the guidance of Secretary District Legal Services Authority, Ganderbal, Tabasum today organized a National Lok-Adalat at Ganderbal. Four (4) benches were constituted for the amicable settlement of cases, three at District Court Ganderbal and One at Munsiff Court Kangan. Overall 700 cases were taken up for settlement, out of which 370 cases were amicably settled/ compromised and on spot Rs.103630 was recovered as fine for violations of different statutes. Rs. 31,13,871 was awarded in MACT cases, NI Act cases, Bank recovery and other cases.
PULWAMA: A National Lok Adalat was organized in District Court Complex here under the chairmanship of Abdul Rashid Malik Chairman District Legal Service Authority (Principal District and Sessions Judge) Pulwama. The National Lok Adalat was inaugurated by Chairman DLSA Pulwama in presence of all judicial officers and bar members. At Pulwama Headquarters, the bench 1 was headed by Abdul Rashid Malik Principal District and Sessions Judge Pulwama and assisted by Rayaz Ahmed Choudhary (Sub-Judge) Secretary DLSA Pulwama. Second bench was headed by Meraj-U-Din Sofi Additional District and Sessions Judge Pulwama and assisted by Mohd Yousaf Malik Advocate. Third bench was headed by Sandeep Gandotra Chief Judicial Magistrate Pulwama and was assisted by MR Thoker Advocate and forth bench was headed by Sheikh Gowhar Hussain and was assisted by Faizan-Ul- Nazar Munsiff/JMIC Pulwama. At Pampore, bench was headed by Junaid Imtiaz Mir and was assisted by President Bar Association, at Tral bench was headed by Mohd Altaf Mir Munsiff/ JMIC Tral and was assisted by the President Bar Association Tral and at Awantipora bench was headed by Raja Arshad and was assisted by the President Bar Association Awantipora. A total number of 364 pre litigation matters were taken up out of which 350 pertaining to far-flung rural areas including Rajpora, Tral and Pampore were settled. A total of 4033 cases of different nature were taken up out of which 3658 cases were amicably settled and an amount of Rs 2,24,92,855 has been settled in MACT, Bank recovery and 138 NI Act cases.
SHOPIAN: A National Lok Adalat was today organized in District Court Complex Shopian with the efforts of Secretary/Sub-Judge, District Legal Services Authority (DLSA) Shopian, Feroz Ahmad Khan. Four benches were constituted out of which 3 benches were constituted for holding of National Lok Adalat at District Headquarters and one bench at Tehsil office Shopian. 162 cases of different nature were taken up before these 04 benches out of which 141 cases were amicably settled and an amount of Rs.1962257/- was realized.
KULGAM: A National Lok Adalat was held today in District Court Complex Kulgam, under the Chairmanship of Pr. District & Sessions Judge Kulgam, Tahir Khurshid Raina (Chairman District Legal Services Authority) Kulgam. The National Lok Adalat was inaugurated by Chairman DLSA. Five benches were constituted three at Headquarter and one each at D.H.Pora and Qazigund. Bench Number 1 was presided over by Tahir Khurshid Raina Chairman DLSA Kulgam (Principal District and Sessions Judge Kulgam) and assisted by Som Lal Presiding Officer Fast Track Court Kulgam and Mohd Shafi Bhat Bar President Kulgam, bench number 2 presided over by Manzoor Ahmad Zargar Chief Judicial Magistrate Kulgam and assisted by Advocate Mohammad Iqbal Bhat Panel Lawyer DLSA, bench number 3 was presided over by Mehreen Mushtaq Secretary DLSA Kulgam and assisted by Advocate Vishal Bharti Additional Special Mobile Magistrate Kulgam, bench number 4 was presided over by Mudasir Bashir Munsiff/JMIC DH Pora and assisted by Syed Roof Geelani Bar President DH Pora and bench number 5 was presided over by Karan Bijyal Munsiff /JMIC Qazigund and assisted by Khursheed Ahmad Sheikh Advocate JMIC Qazigund. In the said National Lok Adalat 1495 cases were taken up, out of which 912 cases were amicably settled. An amount of Rs.60, 45,912 was realized in different cases.
KUPWARA: A National Lok Adalat was organized today across the district. On the occasion, a total of 8 benches were constituted by Chairman District Legal Services Authority (DLSA) Kupwara, Tasleem Arief, (Principal District Judge Kupwara) for taking up a total of 4871 cases of various nature across court complexes of District Kupwara. A total of 200 pre-litigation matters and 2730 Services related cases were taken up and 2755 settled on spot by amicable means which resulted in settlement of Rs. Rs.32, 94,992. Separate benches were constituted at Handwara, Trehgam, Sogam and Tangdar. Out of the total cases taken up, 3941 cases of various nature were settled on spot by amicable means with the intervention of benches and participating advocates which resulted in settlement of Rs 1,87,33,305 worth motor accident claims as well from the bench presided over by Tasleem Arief (Principal District and Sessions Judge Kupwara). Besides a total of Rs 95, 97,000 was realized in recovery cases and Rs. 91, 36,305 realized as compensation and fine.
BANDIPORA: A special Lok Adalat was held at District Court Complex, Bandipora on Saturday by District Legal Services Authority Bandipora under the chairmanship of Principal District and Sessions Judge, Mohammad Ibrahim Wani. On the occasion, 4 benches were constituted for taking up cases of different nature and a total of 1073 cases of different nature were taken up for settlement, of which 952 cases were settled amicably. A settlement amount of Rs 46.84 lakh was realized as settlement amount at the spot. Moreover, different benefits were distributed by ARTO and CMO on the spot while disposing of other public utility matters which were long pending before their office.
KARGIL: District Legal Services Authority Kargil organized National Lok Adalat in which four benches were constituted under the guidance of Chairmen District Legal Services Authority Kargil Ajaz Ahmad Khan. The first bench was presided over by Aiaz Ahmad Khan Chairman DLSA/PDJ Kargil, the second bench was presided over by Tsewang Phuntsog, CJM Kargil, the third bench was presided over by Moneer Ahmad Munsiff Sankoo and the fourth bench was presided over by Abdul Gaffar Zargar ACR Kargil. A total of 284 cases were referred to the National Lok-Adalat and Pre-Lok Adalat Sessions out of the same a total number of 154 cases were disposed of and out of the same an amount of Rs 4124000 was recovered as settlement amount and an amount of Rs 43150 was recovered as fine.
