HC upholds CJM order on registering of FIR against Police officer

Srinagar :The Jammu and Kashmir High Court today dismissed the petition filed by the State challenging the order of the Chief Judicial Magistrate Srinagar for lodging FIR against a police officer in connection with the killing of a man in Srinagar last month.

Justice Mohammad Yaqoob Mir today upheld the orders of the CJM Srinagar (issued on 18-7-2018 and 28-7-2018) regarding lodging of FIR against DSP Yasir Qadri. “In the background of the facts, circumstances and the law noticed above, CJM has exercised the power well within confines of the law. Both the orders, 18-7-2018 and 28-7-2018, are in-conformity and consonance with law, don’t suffer from any illegality. Same will not result in causing any injustice nor is found in any manner, to be abuse of process of the court. As such both the orders are upheld”, the court order reads.

The CJM Srinagar had directed the Senior Superintendent of Police Srinagar for registering an FIR against police officer in case of killing of one Shabir Ahmad on July 10 at Batamaloo area of Srinagar on July 10.
