JAMMU, Nov 5: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has awarded 12 years rigorous imprisonment and fine of Rs 10,000 to Mohd Jahangir Khan, son of Banka Khan of Shahpur, Poonch, who was facing trial for the last 10 years for kidnapping and raping a minor girl.
After hearing Advocate Mohinder Pyasa for the accused whereas Public Prosecutor Choudhary Nazir Hussain for the State, Principal Sessions Judge convicted the accused for commission of offences punishable under Sections 363 and 376(1) RPC.
“The circumstances of commission of crime, the age and the character of the offender, injury to individual or the society, effect of the punishment on the offender, eye to correction and reformation of the offender, are some factors which would be ordinarily taken into consideration by the Court while awarding the sentence”, Principal Sessions said.
“The main offence under Section 376(1) RPC committed by the accused is punishable with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years, and shall also be liable to fine”, the court said, adding “the trial in this case has taken a decade and the accused has his own family”.
With these observations, Court awarded rigorous imprisonment for seven years and fine of Rs 5000 to the accused. In default of payment of fine, he will further undergo imprisonment of like nature for 6 months. For the commission of offence under Section 376(1) RPC, he will undergo rigorous imprisonment for five year. However, both the sentences will run concurrently.
