JAMMU, Mar 19: In the much publicized militant attack at Janipur, Principal Sessions Judge Jammu Vinod Chatterji Koul today awarded 10 years imprisonment to Zaffer Iqbal alias Umar alias Abdul Rehman, son of Mohd Yousaf of district Palendri in Pakistan-occupied-Kashmir.
According to the police case, on 11.08.2007 a team of Delhi Police and Special Branch of J&K Police cordoned the house of one Abdul Rehman, son of Mohd Asgar at Ramzanpura, Janipur in order to effect arrest of a militant namely Saifullah Kari, who was involved in FIR No: 122/2005 of Police Station Special Cell, Delhi.
However, the militant, who was accompanied by another militant, opened fire from an automatic weapon from inside the house in order to flee. The police party returned the fire as a result of which militant Saifullah Kari died and the other accused sustained injuries. The incident led to registration of offences under Sections 7/25 Arms Act, 121-A, 120-B and 307 RPC and 4/5 ES Act.
After hearing Public Prosecutor Rakesh Badyal for the State, the court observed, “having regard to the circumstances of the case, Zaffar Iqbal is sentenced to undergo imprisonment for a period of 10 years and shall also be liable to pay a fine of Rs 20,000 for offence under Section 307 RPC”, adding “in case of his default to pay the fine, he shall further undergo imprisonment for a period of three months”.
He was also sentenced to undergo imprisonment for a period of six months and shall also be liable to pay a fine of Rs 1000 for offence under Section 120-B RPC. In case of his default to pay the fine, he shall further undergo imprisonment for a period of one month.
