JAMMU, Dec 28: Principal Sessions Judge Kathua, A K Koul today acquitted accused namely Rakesh Kumar, son of Som Raj, Munish Kumar, son of Nek Ram and Sanjay Kumar, son of Gian Chand, all the residents of Kathua, who were facing trial in NDPS case.
These accused persons were arrested on September 22, 2007 along with large quantity of intoxicant capsules
While acquitting the accused persons, Principal Sessions Judge Kathua A K Koul observed, “needless to say that the failure of the case is only due to serious lapses committed by the Investigating Officer. One does not understand as to why such lapses are being repeatedly committed while investigating the cases under NDPS Act”.
“Time and again the Investigating Officers have been directed to enhance the skills of investigation and avoid breach of mandatory provisions so that the culprits are brought to book but I suppose the investigating agency is least interested in carrying out the meaningful investigations so that the criminals more particularly those involved in heinous crimes do not escape the dragnet of law”, Principal Sessions Judge said.
“Yet again the resources, time and energy have been wasted for nothing. Is there anyone in the police administration to look at the issue and find out the causes of casual investigation, identify the investigators whose cases fail for want of seriousness on their part and make them accountable so that the rigor of penal law is not emasculated.”
After going through all the witnesses, the court further observed, “there is a complete breach of Section 50 NDPS Act and as such, the investigation gets vitiated and the trial on the basis of vitiated investigation becomes meaningless”.
