JAMMU, Apr 17: Vigilance Organization, Jammu has booked CEO, AEO, E I of Municipal Corporation Jammu and the beneficiary, who constructed huge commercial building in residential area.
During verification conducted by Vigilance Organization into the allegations that on plot No.341, situated at Bakshi Nagar, a huge commercial building was being constructed in residential area in utter violations of Master Plan and Municipal Laws, it was revealed that a residential building permission was issued by BOCA on 10.04.2013 vide No. 49/BS/2013, in favour of Manju Gupta, wife of Vinod Mahajan , resident of 23/P, Extension Trikuta Nagar, Jammu, with permission for build up area as ground floor, 1st Floor and 2nd Floor 1140 sqft. respectively and FAR 190, height 40 ft.
The verification revealed that the beneficiary, in active league with accused officers/officials of Jammu Municipal Corporation and in utter violation of approved plan raised the construction as ground floor, 1st Floor & 2nd Floor 1736 sqft, FAR 95.9 and height 38 ft. with setbacks 1.6 ft. only. It was further revealed that in order to cover up the violations and to provide sufficient time to the beneficiary to raise said construction, a mere formality of issuing notice u/s 7(1), 12(1) of Municipal Act has been undertaken. Thus, the intentional inaction by the accused public servants in league with beneficiary has paved the way to beneficiary and allowed her to raise the construction in blatant disregard and violation of building permission, rules/law.
As such, Case FIR No. —-/2017 P/S VOJ has been registered in Vigilance Organization, Jammu u/s 5 (1) (d) r/w 5(2) J&K P.C Act 2006 and Section 120-B RPC read with section 9 of COBA 1988 on the prima facie establishment of offences on the part of the then Law Enforcement Wing Rajesh Gupta, CEO, Madan Lal, AEO, Kuldeep Kumar, E I of Municipal Corporation Jammu and the beneficiary Manju Gupta.
