Stop salaries of TSOs, Insps: HC

Srinagar, July 21: Justice Ali Mohammad Magrey in a contempt petition directed the Drawing and Disbursing Officers of the CA&PD Department not to draw salaries to the employees whose position as Tehsil Supply Officers (TSOs) and Inspectors has been quashed by the court and are still holding these posts.
Observing that prima facie contempt of court is made out against the contemnors Justice Magrey said, before proceeding against them, they shall be given one more opportunity for complying with the court orders.
Court also directed the authorities to immediately change the position of the officers whose promotion orders have been quashed by the court in terms of judgment dated 26.2.2014 and not to draw their salary against the post of TSOs and Inspectors. High Court warned them that in case they fail to comply with the Judgment, they shall also be proceeded against in accordance with law.
Contempt petition has been filed for implementing the judgment of the court passed in a petition filed by 65 employees of the department seeking quashment of orders issued by the Directorate of CA&PD whereby private respondents were promoted as TSOs.
Court in terms of Judgment dated 26.2.2014 allowed the writ petition of 65 petitioners and quashed the orders of Directorate promoting various employees as TSOs with the direction to accord fresh consideration to the employees of the department belonging to the Kashmir Division including Leh and Kargil districts to the post of TSO on the basis of their seniority.
Petitioner counsel S R Hussain submitted before the court that those TSOs whose promotion has been quashed by the court are still holding these posts and even drawing the pay on these posts.
