Special Tribunal stays Registrar’s order on JCCB

JAMMU, May 8: Judicial Member, Jammu and Kashmir Special Tribunal, Jammu today stayed the  Registrar Co-operative Societies, J&K, order of ceasing powers of Board of Directors of Jammu Central Co-operative Bank Limited, Jammu, and appointing an Administrator for looking after affairs of the bank.
The Judicial Member stayed the order number RCS/LS/566-568 dated May 6, 2014 issued by Registrar Cooperative Societies, J&K and called for the record on the May 23, 2014, the next date of hearing.
The Counsel for Board of Directors of JCC Bank through its Chairman, Mohinder Singh challenged the jurisdiction of Registrar Cooperative Societies, J&K in passing an order, which amounts to suppression of powers of Board of Directors and appointed Joint Registrar (Admn.) Cooperative Societies, J&K without complying with the provisions contained in Section 30 of J&K Cooperative Societies Act, 1989.
After hearing the arguments of Counsel for petitioner, Madan Lal, Judicial Member J&K Special Tribunal stayed the impugned order dated May 6, 2014. The copy of the order passed by the Special Tribunal was served upon the Joint Registrar (Admn.), who after receipt of the order, left the Bank and Mohinder Singh, again took over the command as Chairman of the JCC Bank.
Counsels appearing for MPCS Muthi Rakwalan, which had challenged the JCCB elections, Registrar Cooperative Societies, J&K and Joint Registrar (Admn.) Cooperative Societies, J&K sought time to file objections following which Member Special Tribunal granted time and fixed May 23, 2014 as the next date for arguments.
