SRINAGAR, Feb 3: Taking cognizance of transfer of some under-trial prisoners to various jails of the State, the State Human Rights Commission has directed the Director General Prisons, J&K, to file his response for examining whether such powers exist with him.
According to an order, dated 10-11-2016, issued by DG Prisons, eleven undertrial prisoners have been transferred from one jail to another jail of the State. In view of a judgement of the Supreme Court, an undertrial is in fact in the custody of the court and therefore can not be taken away from a jail in which has is lodged by the court. The Commission has sought to examine whether such powers exist with the DG Prisons, J&K.
While passing the order, Justice Bilal Nazki, Chairperson SHRC, has directed the Director General Prisons to file his response within two weeks.
