NEW DELHI : The Supreme Court today appealed to Prime Minister Narendra Modi and state chief ministers not to include tainted MPs or MLAs, who are facing criminal charges against them,
in their cabinets.
A five-judge constitution bench comprising Chief Justice R M Lodha and Justices Dipak Misra, Madan B Lokur, Kurian Joseph and S A Bobde, however, made it clear that no directions can be issued to prime minister and CMs as it was their prerogative and discretion to select their ministers. Justice Misra, speaking for the majority, said, “It is expected that the PM and chief ministers shall try to avoid inclusion of tainted MPs who are facing serious criminal charges in their council of ministers.”
The Supreme Court delivered its verdict on a PIL filed by one Manoj Narula.
The apex court also noted that inclusion of tainted politicians in the cabinet was against the democratic values. (AGENCIES)
