SAC’s nod to continuation of 13th FC courts

JAMMU, Feb 26: State Administrative Council, which met under the chairmanship of Governor, N N Vohra yesterday, has accorded sanction to the continuation of the courts of Special Mobile Magistrates and Additional Special Mobile Magistrates created under 13th Finance Commission Award.
According to the sources, the State Administrative Council in its meeting held yesterday deliberated upon the issue of posts of Special Mobile Magistrates and Additional Special Mobile Magistrates along with their supporting staff and finally it was decided that these posts shall continue keeping in view their performance ever since their creation under the 13th Finance Commission Award.
In view of this decision, the Commissioner/ Secretary to Government, Department of Law, Justice and Parliamentary Affairs, Mohammad Ashraf Mir today issued order whereby sanction has been accorded to the continuation of the posts of Special Mobile Magistrates and Additional Special Mobile Magistrates along with their supporting staff beyond March 31, 2015—the date from which funding from Government of India for these courts/posts under 13th Finance Commission has ceased.
Moreover, the sanction has been accorded for taking over the liabilities on account of creation of these courts as charge on State exchequer from the date Government of India funding has ceased—April 1, 2015.
It is pertinent to mention here that the previous Government had abolished these 38 courts and the order in this regard was stayed by the State High Court after taking suo-moto cognizance. The State even challenged the decision of the High Court before Supreme Court of India but failed to get relief as the Apex Court dismissed the Special Leave Petition.
