SAC issues notices to Com/Secys GAD/PWD for ATR

JAMMU, Dec 14: Full Bench of State Accountability Commission today  issued notices to the Commissioner/Secretary General Administration Department, J&K and Commissioner/Secretary Public Works Department (R&B), J&K asking them to inform the Commission  as to what action has been taken on receipt of the representation to the Minister for Public Works Nayeem Akhter seeking time bound enquiry by a sitting High Court Judge into the alleged leaked telephonic conversation between former MD JKPCC and one of his subordinates which went viral on social media.
The Full Bench, headed by its Chairperson Chief Justice (Retd) B A Khan and Members Justice (Retd) J P Singh and Justice (Retd) B A Kirmani, after hearing Advocate Sheikh Shakeel Ahmed with Advocates Supriya Chouhan and Mohammad Saalik, appearing for the complainant Sukesh C Khajuria, directed the filing of the Action Taken Report by the Secretaries GAD and PWD on or before February, 8, 2018.
When this matter came up for hearing before the Full Bench of the SAC, Advocate Sheikh Shakeel Ahmed brought the attention of the Commission towards the leaked conversation and submitted that the contents of the same  disclose the sorry state of affairs in JKPCC and how the former MD of JKPCC was trying to strike a deal with officers of SVO by offering illegal gratification.
Advocate S S  Ahmed further submitted that when the aforesaid conversation went viral on social media,  the Public Works Department acted very smartly by issuing Govt  Order No.426-PW (R&B) of 2017 dated 09-11-2017 thereby attaching the former MD JKPCC in the office of Development Commissioner (Works), J&K without whispering anything about the leaked conversation and without ordering a high level enquiry into the matter and the attachment order was styled as a routine transfer in the interest of administration.
Sheikh Shakeel argued that this leaked conversation has shaken the confidence of the public as more than a month has elapsed but no enquiry or probe was ordered into the serious allegations forthcoming from the leaked conversation. He said the entire leaked conversation puts a big question mark on the repute/integrity and credibility of the State Vigilance Organization as the allegations of fixing the top vigilance officers is time and again repeated in the leaked conversation.
Advocate Sheikh Shakeel Ahmed drew the attention of the Commission towards the representation dated November, 21, 2017 made to the  Chief Minister and the Works Minister J&K with copies to  Governor J&K State and Chairman State Accountability Commission seeking judicial probe by a sitting High Court Judge within seven days into the leaked conversation.  He submitted that despite the expiry of more than three weeks nothing substantial came out from the two constitutional functionaries of the State which has constrained the complainant to file the instant complaint before the Commission.
After considering the submissions of Advocate S S  Ahmed at length, the Full Bench issued notices to the Commissioner/Secretary GAD and Commissioner/Secretary PWD (R&B), J&K asking them to inform the Commission on the next date of hearing as to what action has been taken on receipt of the representation dated November, 21, 2017 made by the complainant Sukesh C  Khajuria amongst others to the Minister for Public Works Nayeem Akhter seeking time bound enquiry by a sitting High Court Judge into the alleged leaked telephonic conversation.  The Full Bench further directed the filing of the Action Taken Report by the Secretaries GAD and PWD on or before February, 8, 2018.
