Pvt hospitals violate Labour Laws, Deptt issues notice

SRINAGAR, May 6: Private hospitals in the Valley in violation of labour laws and regulations are providing peanuts to their staff, especially to the nursing staff, as monthly salary.
While the nursing staff falls in Highly Skilled Category as per the SRO 460 of 2017 and should have been paid Rs 400/- per day, which makes the amount Rs 12000/- per month, they are being offered peanuts.
However, the nurses who are working in the private sector are being paid Rs 5000-6000 per month, which is the utter violation of the basic labour laws, especially the said SRO.
Few months ago, a complaint was submitted to the J&K Govt’s Grievance Cell, in which a nurse had complained that while she was working in a private sector, she was being paid the amount which is in total violation of the rules and regulations.
As per the Indian Nurses Council (INC), the nurses who are holding degrees should be paid minimum of Rs 12000 per month. However the complainant has stated that they are being paid Rs 5000-600 per month.
“I am a professional nurse working in private sector. I want to draw your kind attention towards the sheer injustice being done to us by owners of the private hospitals and paramedical institutions,” she had written in the complaint.
The grievance has witnessed a prompt action from the Labor Department, Kashmir which has asked all the Assistant Labour Commissioners in Kashmir Division to seek compliance of the SRO 460. However, so far not all the institutions have responded to notice that was served to them,
Deputy Labor Commissioner (DLC), Kashmir Fayaz Ahmad Banday told Excelsior that he was not aware of the status of the notice which had sought the compliance from the Private Hospital.
“I am not aware about the present status, but, we are on it if there is no compliance on their part after a due process, action can be initiated against them,” he said.
The notice issued has clearly asked the concerned to comply with the minimum wages as per the SRO 460 and follow it in letter and spirit.
“Since the Nurses fall under the Highly Skilled Category and are entitled to be paid wages @ Rs 400/ day as per SRO 460 issued vide notification dated 26-10-2017, as such you are directed to serve notices to all the private hospitals/ Nursing homes running in respective districts for implementation of the above said SRO in its letter and spirit under an intimation to this office,” the notice read.
