Prosecution failure leads to acquittal of narco smuggler

JAMMU, Nov 23: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has acquitted a narcotics smuggler as prosecution miserably failed to prove its case.
The narcotics smuggler namely Abdul Hamid, son of Abdul Rahim of Thanamandi was arrested by Police Post Behramgalla on April 25, 2010 along with 16 packets of maize cob-web containing charas. A case under Section 8/20 NDPS Act was registered against him and after completion of investigation challan was presented in the court of law.
After hearing both the sides, Principal Sessions Judge Poonch, Jaffer Hussain Beigh observed, “it has also been brought to the knowledge of the court that all the prosecution witnesses examined in the instant case are police officials and the single civil witness examined by the prosecution has not supported the prosecution at all”.
“The other important witness has stated that at the time of the search there were a number of people on spot. Moreover, there were residential houses near the place of occurrence but no independent witness was called. This prosecution witness has even stated that the persons in whose presence the charas was seized were not kept as witnesses”, the Court said.
With these observations, Court acquitted the accused of the charges leveled against him.
