Prosecution failure leads to acquittal of 7 in murder case

JAMMU, June 16: Principal Sessions Judge Jammu, R S Jain today acquitted seven accused namely Chanderkant, Vikram Singh, Jasbir Singh, Vijay Kumar, Ganesh Kumar, Surinder Singh and Rakesh Kumar, who were facing trial in murder case, as prosecution miserably failed to prove the case.
After hearing Senior Advocate Sunil Sethi and Advocate SDS Saini appearing for the accused, Principal Sessions Judge observed, “mere suspicion, however, strong or probable it may be is no effective substitute for the legal proof required to substantiate the charge of commission of a crime and grave the charge is greater should be the standard of proof required”.
In the present case, prosecution has been unable to prove the guilt of accused by cogent and clear evidence, the court said. Accordingly, accused Chanderkant, Vikram Singh, Jasbir Singh, Vijay Kumar, Ganesh Kumar, Surinder Singh and Rakesh Kumar were acquitted.
