Prosecution failure leads to acquittal of alleged terrorist

JAMMU, Aug 14: Principal Sessions Judge Bhaderwah, M K Sharma has acquitted alleged terrorist Abdul Gani, son of Ali Mohammad, a resident of Chanyas, Doda, who was allegedly involved in an attack carried out in Gandoh tehsil on September 3, 2003 in which two ITBP jawans lost their lives.
After taking the evidence for the prosecution, hearing the prosecution and the defense, Principal Sessions Judge observed, “there is no evidence on the record to establish that the accused committed the offences of which he is charged with. The challan, therefore, fails”.
Accordingly, the court acquitted the accused of the charges leveled against him and directed that he should be released forthwith if not required in any other case.
