Post Art 35A abrogation: HC invites applications on all India basis

JAMMU, Dec 29: In a clear rebuff to the pro-domicile forces, the Common High Court of Jammu and Kashmir and Ladakh has invited applications from across the country for various categories of posts before January 1, 2020.
As per the Advertisement Notice No.09/2019 dated December 26, 2019 issued by Registrar General of High Court Sanjay Dhar, applications have been invited from the residents of Union Territories of Jammu and Kashmir and Ladakh as well as from other parts of the country for 33 posts of different categories (non-gazetted) to be filled through direct recruitment mode.
“The application forms shall be received by the concerned Principal District Judges of Union Territory of Jammu and Kashmir and Union Territory of Ladakh within whose jurisdiction the applicant resides against the proper receipts duly stamped”, reads the Advertisement Notice.
The notice further reads: “The applicants who do not belong to Union Territories of Jammu and Kashmir and Ladakh shall submit their applications to the Registrar General, J&K High Court Jammu”.
The Principal District Judges of Kashmir Province and of Bhaderwah and Kishtwar districts and Principal District Judges of Union Territory of Ladakh shall make necessary arrangements for the receipt of application forms even during the ensuing winter vacations.
“All Principal District Judges of Union Territory of J&K and Union Territory of Ladakh shall submit the application forms along with the list of documents to the office of Registrar General , J&K High Court Jammu by or before February 7, 2020”, the Registrar General said in the Advertisement Notice.
It has been made clear in the Advertisement Notice that the selection shall be made as per Jammu and Kashmir Reservation Rules, 2005. The candidates who are having age as on January 1, 2019 not below 18 years and not above 40 years in case of open merit, 43 years in case of SC/ST/RBA/ALC/ OSCs, 42 years in case of physically challenged, 48 years in case of ex-servicemen and 40 years in case of candidates in Government Service/contractual employees are eligible for participation in the selection process.
The posts which have been thrown open for participation by any candidate from any part of the country are Senior Scale Stenographer, Junior Scale Stenographer, Steno-Typist, Compositor etc and graduation from any recognized university has been prescribed as minimum qualification. The selection shall be made through direct recruitment mode.
It is for the first time that applications have been invited from even those persons, who don’t belong to Jammu and Kashmir and Ladakh. Earlier, due to Article 35-A the candidates belonging to the erstwhile State of Jammu and Kashmir were eligible for posts not only in the High Court but in all the Government departments.
It is pertinent to mention here that Article 35-A of the Indian Constitution, which empowered the Jammu and Kashmir State’s legislature to define “permanent residents” and provide special rights and privileges to those permanent residents was scrapped by the Parliament along with Article 370 on August 5, 2019 and accordingly erstwhile State was bifurcated into two Union Territories.
The Advertisement Notice inviting applications from even those people who don’t belong to J&K and Ladakh Union Territories is a clear rebuff to the politicians, who were claiming that domicile like option will be considered to protect land and job rights of the locals.
According to the sources, all the posts in the High Court of Jammu and Kashmir and Ladakh will remain open for participation by candidates from any part of the country in future also.
“Similar approach will also be adopted by other Government establishments in the UTs of J&K and Ladakh”, sources further said.
