JAMMU, Feb 3: Chief Justice of J&K High Court, Justice N Paul Vasanthakumar today said that all the physically challenged persons have the statutory right to work at healthy and safe places.
This observation was made by the Chief Justice in a petition filed by a disabled person namely Naresh Kumar Jain, who challenged his transfer from Government SRML Higher Secondary School to Government Girls Higher Secondary School Pallanwala.
While setting-aside the transfer order, Chief Justice observed, the physically challenged persons have statutory right to work at healthy and safe places, which can be insisted by them as a matter of right under Section 27 of the Jammu and Kashmir Persons with Disability (Equal Opportunities, Protection of Rights and Full Participation) Act, 1998.
“Also on the ground of violation of human rights, the transfer order issued so far as transferring the petitioner from Government SRML Higher Secondary School Jammu to Government Girls Higher Secondary School Pallanwala is bad”, Chief Justice further said.
