Sir,
A news item published informs that in respect of Central Government pensioners; the order of the CAT has been confirmed by the Delhi High Court which lays that the arrears of the corrected anomaly under the 6th Pay Commission is payable w.e.f. 01-01-2006.
However the Central Govt granted the arrears from 24.9.2012 holding that once a mistake was admitted by the Govt., it could not be applied prospectively; i.e. from the date of inception and not any future artificially created date.
The State of J&K vide its order No:-57-F of 2013 dated: 11.03.2013 has ordered the payments of these arrears to its pensioners who retired prior to 2006; from an arbitrarily fixed date of 01-01-2013; which is un-justified.
The matter is brought to the notice of the State Govt: for rectification of this artifically created date. As also the pensioners associations both at Srinagar and Jammu for agitating this matter so that the anomaly-arrears are paid from the actual due date of 01-01-2006.
