Unworthy of its name

The hospital in Boulevard, Srinagar, named after a great son of India namely Govind Ballabh Pant is hardly worth the name given to it. Pant was a front line soldier in India’s struggle for freedom, a reputed Congress leader, Union Home Minister and once Chief Minister of Uttar Pradesh. In a hospital named after him, 352 children, mostly infants, died from January 1 to May 15, 2012, (total of 135 days). It means nearly two infants died in one day onwards of 1 January. During this week alone, more than 30 children have died according to a statement of the State Health and Medical Education Minister. In a shockingly belated action the Medical Superintendent has been attached and the Health Secretary has announced several improvements that will take years to come to fruition. Where were the concerned authorities so far? Why was this hospital left to be more a butchery than a hospital of a civilized society? How can Government escape its responsibility? People want action against the defaulters not lip service of streamlining the functionality. People demand delivery and it must come.

Parliament turns 60
Sir,
We have had a sustained democracy, except emergency prelude, in a country with numerous complexities whereas no other country in Asia except only a few in East, have been fortunate in this regard.However,the experiment has not been without traumatic travails. One cannot eulogize today the usual happenings inside the august Parliament house and the consequences that outflow from it.
The fight scenes, physical scuffles, hurling of chairs and microphones, high-pitched abuse or oration, continue speaking defying presiding officers, defections, manipulations in Parliament of public representatives by vested interests, cannot be a model for or a matter to be emulated by masses.
Lack of self discipline has resulted in governance deficit at all levels and apprehensions of failing state in face of rampant corruption,escalating crime, helplessness against terrorism, cynicism in dispensation of justice in courts or otherwise, are deeply impacting the minds of the people.
Quid pro quo to democracy, political dynasts have emerged mocking the concept and all those who sacrificed for it for years world over. All MPs from Congress below the age of 35 years elected to 2009 Lok Sabha are from political families and in many cases 4th generation is ruling both the center and states. Such thing is not happening in China . Representatives once gain power through vote and finances through arbitrary taxes,tend to act like medieval manors.They have enhanced their prowess and perks manifold. Nothing can happen without their consent. MPLAD and CDF has gone up five times incremented eroding level playing field to new competitors. Subjugation by political class is suffocating and is anarchic in this century of knowledge, human liberties and equity.
The feel good in economic sector on large fiscal receipts from private and service sectors has started evaporating.Creation of China like infrastructure even in vital sectors has not materialized, the public money is spent on populous schemes for vote bank. In last two years borrowing has peaked to 37 percent more from foreign institutions.Taxes escalating and being forced on public without their consent for frivolous state spending. Inflation especially in food items is highest and value of rupee has run down the drain.
Socially, today society is more fractured. Rich and politically powerful classes both from reserved or otherwise matter; others are disadvantaged, disillusioned and frustrated.This ominous is happenig in a country where there is bounty of natural, climatic and human resources and world class talent and enquiry is on, on Parliament turns 60, to find out Neros of country.

Use of drugs
Sir,
Drug costs are sky rocketing and it is hoped that accountability will be introduced at all stages: manufacturing, sales, distribution, purchase, prescription, dispensing and post-marketing analysis. Strengthening, security, back up facilities and empowerment of enforcement authorities would ensure the fulfilment of the objective to streamline availability of highly efficacious, yet lower cost drugs. In many cases, patients are badly suffering, since drug costs of same salt varies many folds across various brands. It is my fervent appeal to common people to have a serious look over rapid growth of pharmaceutical trade in our state. A serious imbalance is apparent between prosperity and accountability. The prosperity must not come at the cost of human life; it would have otherwise serious repercussions, (we are virtually endangering our health and drug addiction has reached to alarmed levels). Easy availability of drugs is a single contributing factor to drug addiction and due to the lucrative nature of drug peddling, locals hoard these medicines and sell them at higher prices to the addicts. It may be a fact that a few unemployed youth get livelihood in pharmaceutical trade at various levels, and may get initially affected by proposed drug policy. Yet, the overall harm done by marketing of costly drugs usually over-weigh benefits. Licenses should be only granted to qualified candidates and exclusively to diploma holders (pharmacy), since as per media reports, there is already mushrooming of premises (both retail chemists as well as wholesale pharmaceutical dealers) and irony is that, as of now, majority of drug license holders are matriculates Rashid, Doda.

Home Secretary’s jaunt

Few days prior to his impending visit to Islamabad to continue bilateral talks with his Pakistani counterpart, the Home Secretary made a quick visit of two trading points opened on the LoC, one along Uri-Muzaffarbad and the second along Poonch-Rawlakot route. This signifies that trade between two parts of J&K State has assumed more importance in contributing to the improvement of bilateral relations between the two estranged countries. Trade began three years ago and kept on moving steadily despite some roadblocks. The beginning of this particular confidence building measure has been at snails pace; it was so designed because it was the first ever attempt of straightening relations between the two parts of the divided state. This experiment has not to be considered only in terms of the volume of trade and the money transacted; its impact on the mindset of people and the Government and its political fallout are of equal importance. In fact political implications were the main objectives that led to the espousal of trade relations.
The Home Secretary listened to a number of suggestions made by the concerned traders of how commercial activity between the two parts can be expanded and streamlined. At Chakan-da-Bagh, where he held important meetings with the traders and their organizations, and also with State Government officials, the Home Secretary spoke to the press as well and communicated his impressions of various aspects of trade across the LoC. Readers will find its details in the print media. But there are a few points that need to be highlighted in connection with Home Secretary’s impending visit to Pakistan.
About political aspect of his visit, he has said it openly that he would reiterate Government of India’s demand that Pakistan hand over 20 “most wanted criminals” to India including Hafiz Saeed, who India thinks, is directly involved in Mumbai attack. This is India’s long standing demand but Pakistan has stubbornly rejected it offering one or the other excuse. Nothing remarkable has happened in between that brings pressure on Pakistan to react otherwise to India’s renewed demand for extradition of these criminals. Therefore no positive response should be expected from Pakistan on this issue. Current internal political situation in Pakistan is too delicate and uncertain to vouch for any promise on the part of the Government to accede to this particular demand of New Delhi. However, it has become ritualistic for New Delhi to go on harping on the tune. That the US placed a heavy prize on the head of Hafiz Saeed for giving proof of his involvement with al-Qaeda should not bring any solace to India. The US Congress is discussing providing 2.5 billion dollars by way of aid to Pakistan. US-Pak relations are on a different strategic plan and India has no role in that.
Secondly, focusing on expansion and streamlining of trade across LoC is certainly of much importance to both sides. There is unmistakable indication that improved relations between the two parts of Kashmir will have soothing and stimulating effect on overall relationship between the two countries. If the people of PoK are able to obtain space eastward through trade, commerce, tourism, cultural activities etc. this will gradually erode their sense of having got sandwiched between two unfriendly environs. “Azad Kashmir” has never been really happy with Pak domination. In fact Islamabad has truncated it, and reduced it to a small north to south longish strip of land. Detachment of Gilgit-Baltistan engineered by the rulers in Islamabad has dealt a sever blow to everything that “AJK” stands for. More than half a million of its population left for western countries to work as labourers because work was not available at home. Most of them are settled in UK and have become prosperous with the passage of time. Their remittances back home are enormous but that money goes for the development of Pakistan and not their homeland. This is the sense of deprivation with them. Mangla dam was constructed with their money and its power is supplied to towns and villages in Punjab. They have all welcomed the opening of the trading points along LoC.
On Kashmir side, many families were divided in the aftermath of partition of 1947. There was and continues to be a genuine urge with the relatives to see their kith and kin. Apart from this there is also need to assuage what is often termed natural instinct among the people of the valley that they are no landlocked or one-tracked. They also want space to reduce the impact of what is called “alienation”. Therefore taking all these matters into account, it is a welcome move on the part of the Union Home and External Affairs Ministries to address all the difficulties impeding brisk trade between the two parts. Easing of visa regime, increasing frequency of trading days, enhancing the number of carriers, opening more viable trading points, conversion of barter to currency system, offering banking facilities and foolproof security against hawala transactions etc. are all negotiable issues. We hope that in his forthcoming meeting with his counterpart in Islamabad, the Home Secretary will be able to resolve all these issues to the entire satisfaction of the traders on both sides.

SRINAGAR, May 17: Following alarm raised over the high infant mortality at the G B Pant hospital, the Government today ordered attachment of Dr. Javed Chowdhary, Medical Superintendent of the hospital.
Dr. Mushtaq Ahmed Rather, Medical Superintendent, LD Hospital has been asked to hold additional charge of Medical Superintendent G. B. Pant Hospital.
The action was taken after the submission of an interim report submitted by Director SKIMS, Dr. Showkat Ali Zargar to the Government. The Government had appointed Dr. Zargar to conduct inquiry into deaths which have occurred recently in G. B. Pant hospital here at Sonawar.
Addressing a hurriedly arranged press conference here, Commissioner Secretary, Health and Medical Education, Manoj Kumar Dwivedi said that Dr. Chowdhary has been attached. He said the charge of the hospital has been given to Dr. Mushtaq in addition to his own duties. He said Government would take every step to save the lives of the children admitted at the hospital.
Dwivedi said that as an interim measure to deal with the crisis about 40 nurses and para-medical staff are being inducted for better management of the hospital. He said more equipment including ventilators, ambulances and life saving drugs are being procured in a time bound manner for the better management.
“Two consultants have been tasked to oversee the management and treatment in Neonatology section of the hospital. An advisory committee has also been constituted for better management of the hospital. This committee would comprise of the experts of relevant field and members from civil society will be co-opted to suggest measures for improvement of this hospital on a regular basis,” said Dwivedi.
He said a KAS officer of the rank of Additional Secretary in the Health and Medical Education Department would be tasked to monitor the improvement in the hospital on a daily basis. He said the officer will submit report to the Health and Medical Education Department and also Chief Minister, Omar Abdullah.
Dwivedi said that Director SKIMS has been asked to submit a detailed report in shortest possible time. He said action would be taken against the people found guilty of negligence in their duties.
It would be in place to mention here that Health and Medical Education Minister, Rajinder Singh Chib had yesterday acknowledged that 352 children mostly infants died at the G B Pant hospital from January 1, 2012 to May 15, 2012. More than 30 children have died in the hospital during this week so far.
Pertinently, Dr. Chowdhary had deputed three doctors, Dr. Kaiser Ahmad, Dr. Muzaffar Jan and Dr. Ghulam Rasool to the Lalded hospital.. This step drew sharp criticism from many medicos and they said that this step would badly affect the functioning of the G B Pant hospital.

JAMMU, May 17: Union Home Secretary RK Singh said today that India would reiterate the demand for extradition of 20 “most wanted militants’’ from Pakistani including Lashkar-e-Toiba (LeT) Chief Hafiz Sayeed during the Home Secretary level talks in Islamabad, Pakistan on May 24 and 25.
He said India was committed not to allow cross-LoC border trade to be misused for hawala transactions for funding terrorism. However, at the same time, the Government would take all possible steps to boost the trade on bother cross-LoC routes of Uri-Muzaffarabad in Kashmir and Poonch-Rawlakote in Jammu besides International Border of Wagah in Amritsar district of Punjab.
In a brief chat with media persons at Chakan-Da-Bagh situation at zero line dividing India and Pakistan in border district of Poonch this morning after holding a high level review of cross-LoC trade with businessmen and officers in two separate meetings, Mr Singh said India would press for extradition of LeT Chief Hafiz Sayeed from Pakistan as he was an accused in 26/11 terror attack on Mumbai.
The Union Home Secretary, who was on a two days visit of the State, flew to Poonch from Srinagar at 8 am today along with State Home Secretary B R Sharma and Director General of Police (DGP) Kuldeep Khoda. After review of cross-LoC trade, Mr Singh visited Salamabad on Uri-Muzaffarabad route and held similar meetings there with traders and officers. He flew back to New Delhi this afternoon. Last night he called on Governor NN Vohra and Chief Minister Omar Abdullah at Srinagar and discussed internal security situation and other aspects with them.
“We will also ask Pakistan to handover all 20 “most wanted militants’’, whose list has already been furnished to Pakistan a long back’’, he said. The list included United Jehad Council (UJC) and Hizbul Mujahideen supremo Syed Salah-ud-Din and Khalistan Zindabad Force (KZF) Chief Ranjeet Singh Neeta, both of whom hailed from Jammu and Kashmir. Under world don Dawood Ibrahim also figured in the list. While Salah-ud-Din was operating from Muzaffarabad in Pakistan occupied Kashmir (PoK), Neeta was based in Lahore. Dawood, however, keep on changing his hideouts.
Pointing out that Hafiz Sayeed was wanted to India in 26/11 terror attacks of Mumbai, the Union Home Secretary said he would seek his extradition during talks with his Pakistani counterpart at Islamabad on June 24 and 25.
Recently, the United States had declared a bounty of 10 million on the head of Hafiz Sayeed and other Pakistani terrorists.
Besides seeking extradition of 20 “most wanted militants’’ and LeT Chief Hafiz Sayeed, the Home Secretary level talks between India and Pakistan would also discuss Confidence Building Measures (CBMs), cross-border terrorism and cross-LoC trade, the Home Secretary said.
Replying to another question on misuse of cross-LoC trade for funding terrorism through hawala transactions, R K Singh said the Government of India has put a mechanism in place to check this illegal practice.
“There have been reports wherein hawala money had been routed through cross-LoC trade on both Poonch-Rawlakote and Uri-Muzaffarabad routes. This practice would be curbed. Directions have been issued to ensure that accounts of every traders were check after six months to tally them with items imported and exported by him’’, Mr Singh said, adding the imports and exports by the traders should match till the barter system of trade was in place.
Worthwhile to mention here that some traders on two routes had imported more items than exported and used rest of the money for funding terrorism in Jammu and Kashmir and other parts of the country. Police had unearthed the practice and booked the traders involved in hawala transactions.
Considering major demand of the cross-LoC traders, which had also been endorsed by Chief Minister Omar Abdullah, the Union Home Secretary said the Government of India favoured converting the trade from barter system to currency. However, the conversion required consent of the Government of Pakistani.
“I would take up the issue with Pakistan Government for switching over to currency based cross-LoC trade at both Poonch-Rawlakote and Uri-Muzaffarabad routes’’, he said expressing confidence that Pakistan Government would accede to the demand.
There had been a proposal for setting up bank branch on either side of the LoC at Chakan-Da-Bagh and Salamabad to facilitate the traders to import-export goods on payment basis instead of present barter system.
Asserting that demand of the traders for free import-export on the two routes excepting a negative list would depend consent of both Indo-Pak Government and could take time, Mr Singh till then the Union Government would take steps to ensure that there were no restrictions on 21 items approved by both India and Pakistan for import-exports on two cross-LoC routes.
“It would be ensured that Standing Operating Procedure (SOP), which was in place for governing cross-LoC trade was properly followed and all 21 items were allowed by both countries for import and export’’, he added.
It may be mentioned that some of the items have been banned by authorities on this side for export to PoK while PoK trade authorities have also banned few items for import by the traders on this side.
To a question, Mr Singh said export of banana and coconut from this part of divided State to PoK should be allowed if the items fell in the list of 21 approved items.
The Home Secretary also conceded another major demand of the traders of Poonch-Rawlakote route for increasing number of trucks used for exporting items to PoK to 50 instead of 25 at par with Uri-Muzaffarabad route.
“There would be no disparity between the traders. At both the routes, 50 trucks would be allowed from now onwards’’, Mr Singh assured the businessmen during his meeting with them at Chakan-Da-Bagh.
At present, 25 trucks were allowed to cross over to PoK from this side daily on Poonch-Rawlakote route on four days of trade (Monday to Thursday) while 50 trucks were allowed from Salamabad (Uri-Muzaffarabad route). The traders of Poonch had, for the past quite sometime, been demanding that number of the trucks should be unlimited or, at least, 50 per day.
On restoration of communication facility for the traders (ISD link) from Jammu and Kashmir to PoK, Mr Singh said this demand required thorough examination as the link was closed due to security considerations on apprehensions that it could be misused by the anti-national elements. Nevertheless, he assured the traders that the demand would be taken up at highest level and appropriate forums.
Chief Minister Omar Abdullah had recently supported the demand.
Mr Singh said the traders demand for a meeting between the businessmen dealing in cross-LoC trade every month at Trade Facilitation Centre (TFC) either at Rangarh in Poonch or Hajeera in PoK instead of Chakan-Da-Bagh zero line would be considered.
“As the traders of either side had to cross LoC for holding meeting at the TFC or Immigration Centres, it required permission of both the Governments of India and Pakistan, The demand would be taken up at appropriate level and hopefully acceded’’, he told the traders.
The Cross-LoC Traders Federation has decided to increase the number of their members from 44 to 60 i.e. 15 each from each side of Chakan-Da-Bagh and Salamabad instead of earlier 15.
The Association submitted a memorandum to Mr Singh demanding installation of full body X-Ray scanning machine at Chakan-Da-Bagh for speedy clearance of items and increase number of trucks used for export of items. “This will also serve the purpose of security and safety of goods and faster processing’, they said and also demanded construction of a yard for parking of at least 200 trucks.
The Association demanded that if cross-LoC traders meetings couldn’t be arranged at Immigration Centres, the authorities should construct pre fabricated huts at zero line for comfortable meetings. They demanded that the Government should publish a negative list and allow trade of all other items. They called for widening of road from Betar Nalla bridge up to TFC Rangarh for smooth movement of trucks.
They called for setting up of One Man Trade Authority for overall control of the trade to enhance coordination between Customs and Custodian Departments as well as security agencies. They said cross-LoC trade should continue with zero tariffs instead of treating it as an international trade. They demanded cold storage facility at the TFC for fruit traders.
They demanded that the traders from both sides should be given business permits so that they could visit each other’s territory, see the items, assess their value and then place orders to give boost to cross-LoC trade.
Mr Singh also had a detailed meeting with local officers at Chakan-Da-Bagh. Among other present in the meeting included Home Secretary BR Sharma, DGP Kuldeep Khoda, Deputy Commissioner, Poonch, A K Sahu, SSP Poonch Shamsheer Hussain, Additional SP Poonch Yougal Manhas, Additional DC Jatinder Singh and officials of other concerned agencies including Customs and Immigration.
Poonch Brigade Commander M K Maggoo also met the Union Home Secretary. Poonch MLA Aijaz Jan and MLC Jehangir Mir were also present.
The cross-LoC trade on Uri-Muzaffarabad and Poonch-Rawlakote had recently been increased from twice a week (Tuesday and Wednesday) to four days (Tuesday to Friday). However, in the absence of increase in number of items and use of currency, the trade had not been picking up, sources said.
It may be mentioned here that the trade between India and Pakistan through the land route has soared by 44 per cent in 2011-12 to Rs 2,341 crore from Attari-Wagah route.
Though the balance of trade is still in India’s favour, the import from Pakistan through land route rose by over 100 per cent to Rs 965 crore in 2011-12 against Rs 453 crore in the previous fiscal.
Mr Singh instructed district Poonch administration and Army authorities for construction of visitors shed at LoC for facilitating the meetings of traders periodically to clear their accounts and hold face to face interaction.
The Home Secretary also reviewed facilities and other arrangements available at Immigration and Custom Office at Chakan-Da-Bagh crossing point at an officers meeting. He instructed district administration and Army that no compromise be made on the issue of nation’s security and integrity of the country, adding that strict vigil and checking be ensured to check hawala like trades.
He also instructed the administration that four sniffer dogs and deployment of additional staff at immigration and custom office be ensured. He said that the issue regarding clarification of pending applications of PoK side would be taken up with concerned authorities during his ensuing visit to PoK.

Azad, Dwivedi to attend Srinagar convention: Prakash

JAMMU, May 17: Union Minister for Health Ghulam Nabi Azad, All India Congress Committee general secretary and party’s Chief spokesperson, Janardan Dwivedi (MP), said to be a trusted Lieutenant of AICC president Sonia Gandhi and former Union Minister M L Fotedar, are participating in the crucial Kashmir convention of the Party being held at Sher-e-Kashmir International Convention Centre (SKICC), Srinagar on May 19.
The significant of this important political activity is viewed by the political analysts much more than the routine process of adopting a resolution by nearly 350 Congress delegates, authorising AICC president Sonia Gandhi to nominate J&K PCC president. Mr Dwivedi, who is also considered to be a think tank of the party and observer from the Party high command is likely to sound a clear message among all rank and file of the party in the State to shun factional behavior and turn into a single disciplined unit of the party at all levels. The convention may also take review of the entire political scenario in the State.
Senior CWC member and party in-charge for J&K, Mohan Prakash, told the Excelsior that this convention has great importance because it is being held after long time. It should have been held earlier. An important political resolution will be adopted and passed in this one day convention. Though he avoided to give any hint about this resolution but said that after the conclusion of the convention you will come to know about it.
“Unity and discipline in the party will be clear message to all the partymen in the State. No factionalism behaviour, as already sounded by the AICC president in strong words, will be tolerated any more in the party. All the party people from all blocks, districts and provinces will be seen at the single platform from May 19 onwards and for this reason, the significance of this crucial meeting is much more”, Mr Prakash maintained.
Responding to a question, CWC Member said besides Mr Dwivedi and Mr Azad, he himself will be attending the meeting. Soz is the sitting party president and so he has to be there. Invitations have also been extended to former Union Ministers M L Fotedar and Dr Karan Singh. Over 350 Congress delegates including sitting Ministers, legislators, former Ministers, MPs, district presidents and at least one representative from each Block will be participating in this convention. As per the procedure, the Congress delegates, reposing faith on their leader Sonia Gandhi, would authorize her ( AICC president) to nominate the J&K PCC president. After the formal announcement of the new PCC president, the PCC will also be framed shortly. Though he avoided to give any time frame for it but maintained that this exercise will be completed in consultation with PCC Chief and Ghulam Nabi Azad besides other important functionaries.
Sources in the party disclosed that a consensus has been reached on the name of Prof Saifuddin Soz and he is likely to emerge as the choice of the AICC for the second consecutive term as PCC Chief. Prof Soz is arriving in Srinagar from the Union capital tomorrow. PCC vice president and coordinator of the convention Ghulam Nabi Monga said though invitations have been extended to the Union Minister and former Sadr-e-Riasat Dr Karan Singh and former Union Minister M L Fotedar but they have not confirmed their participation so far. He said, “We have made arrangements for 350 delegates in the SKICC Hall and programme will commence at 11.30 on Saturday”, Mr Monga added.

DB directs GAD, SVO to submit status of FIRs

PIL seeking prosecution of Sr IAS, KAS officers in corruption cases

JAMMU, May 17: In the Public Interest Litigations (PILs) seeking prosecution of Senior IAS and KAS officers involved in the corruption cases, Division Bench of the State High Court comprising Justice Mansoor Ahmed Mir and Justice Muzaffar Hussain Attar today directed Commissioner Secretary General Administration Department (GAD) and Commissioner of Vigilance to submit the status of the FIRs indicated in the PILs within two weeks.
The Division Bench further directed the Registry to convey this order to the Secretary General Administration Department and Commissioner of Vigilance and list the PIL immediately after two weeks.
These PILs have been filed by two social activists namely Sheikh Mohd Shafi, son of former MP Sheikh Abdul Rehman and Prof S K Bhalla seeking directions to the State Vigilance Organization (SVO) to file charge-sheets against high-profile accused in the FIRs relating to Canal power house, illegal appointments in local bodies, rural electrification scam, Gulmarg land scam and FIRs against Babu Ram, then CDPO Doda and Ghulam Hassan Wani, Joint Registrar Cooperative Kashmir, in view of the deemed sanction for prosecution as per the law laid down by the Supreme Court in case titled Dr Subramanian Swamy Vs Dr Manmohan Singh and another decided on January 31, 2012.
After hearing Advocate Sheikh Shakeel Ahmed, Division Bench observed, “before issuing notices to the respondents, it is deemed appropriate to direct Secretary GAD and Commissioner of Vigilance to submit the status of the FIRs mentioned in the PIL”.
Advocate Ahmed drew the attention of the Court to the landmark judgment passed by the Supreme Court of India wherein a limit of three months has been fixed for the sanctioning authority to accord sanction in corruption cases.
In the petitions it has been mentioned that in FIR No. 8/2009 VOK (Gulmarg land scam), it has been admitted by the General Administration Department that case was received on December 22, 2009 and the prosecution was sanctioned vide Govt Order No.02-GAD (VIG) of 2010 dated January 18, 2010.
“The competent authority accorded sanction for the prosecution of only small fries but is sitting over the sanction of Mehboob Iqbal, then Divisional Commissioner Kashmir, Farooq Ahmed Shah, then Additional DC Baramulla and Baseer Ahmed Khan, then Deputy Commissioner Baramulla”, the petitioners said while seeking directions of the Court to the respondents to disclose the reasons for such a prolonged delay in granting sanction against senior officers despite the fact that State land worth crores of rupees was illegally transferred by misusing the provisions of Roshani Act.
The case FIR No. 17/2010 against Ghulam Hassan Wani, then Joint Registrar Cooperative Audit was received by GAD on December 26, 2011 for prosecution sanction and the Commissioner of Vigilance was requested on January 17, 2012 to furnish comments on the representation of the accused officer but the same have not been furnished till date.
The petitioners have also highlighted the inaction of State in sanctioning prosecution in case FIR No 18/2005 VOK relating to much publicized Rural Electrification Scam in which Syed Asgar Ali, then Director Rural Development Kashmir and presently sitting PDP MLC was allegedly the prime accused along with BDOs Zaffar Altaf, Mohd Yousaf Bhat, Mohd Yousaf Ganie Abdul Hamid Wani and Mohd Saleem Khanday.
In this case, the proposal for sanction was received in the GAD on January 15, 2008 and the case was processed for orders of the competent authority but the same is under submission since January 14, 2009.
In the case FIR No 22/2009 VOJ registered against Babu Ram, then CDPO Doda, Vigilance Organization sought sanction on August 16, 2011 and the case was referred by the GAD to Social Welfare Department on January 12, 2012 for comments which are still awaited.
Similarly, in FIR No 21/2006 sanction was accorded against the small employees of Local Bodies but the same is yet to be granted against AK Raina, then Director Local Bodies whose representation for declining sanction is pending before the GAD.
“The respondents have double standards while according sanction in terms of Section 6 of Prevention of Corruption Act”, the petitioners alleged, adding “even Chief Minister declined sanction for prosecution of a sitting Cabinet Minister Ghulam Hassan Mir, who was allegedly involved in making 53 illegal and backdoor appointments in J&K Legal Service Authority”.

Court awards 17 yrs RI to owner of Finance Company

JAMMU, May 17: Principal Sessions Judge, Jammu Jang Bhadur Singh Jamwal today awarded 17 years rigorous imprisonment and fine of Rs 3.50 lakh to Bodh Raj, son of Kaka Ram of Shastri Nagar, owner of Bharat Finance Company, Kanak Mandi.
According to the police case, one Shera Bibi had deposited an amount of Rs 4 lakh with the M/s Bharat Finance Co. Jammu. Later, on various occasions, she withdrew total amount of Rs 83,000 thereby leaving balance of Rs 3.17 lakh with the finance company.
In order to dupe the complainant of hard earned money, Bodh Raj prepared a fake ‘Hundi’ for transferring her account in the name of her husband Bashir Ahmed mentioning that same has been adjusted against the alleged debit of her husband, which in fact had neither been obtained nor the hundi signed by Bashir Ahmed.
In this way, the owner of finance company cheated the complainant of Rs 3.17 lakh. Acting on the complaint of Shera Bibi, police registered a case for offence under Section 420,467 RPC against the owner of the finance company.
After hearing Public Prosecutor Shabir Choudhary for the State and Advocate Krishan Kumar for the accused, Principal Sessions Judge observed, “prosecution has successfully proved the case against the accused, who obtained the signature of complainant on a simple unwritten paper and with his own hand writing he transferred the amount to the loan against her husband”.
The Court further observed, “the economic offences are on rise and activities of such kind of persons those who are looting the countrymen is also on increase. Within the days, the companies are flouted and lot of people duped of their valuable securities and money and thereafter companies are closed”, adding “their offices, run away from one place to another, ruins the innocents persons of the country. Many people are lured by these companies obtained the deposits tendering them assurances of higher rate of interest”.
“Tender mind is arrested with shackles of allurement on higher rate of interest which every one would like to have. J&K is a soft target for such kind of cheaters. The punishment has to be deterrent for others to look at”, Principal Sessions Judge said, adding “Court is conscious of the age of the accused and particularly ailment—medical report given by Dr Devinder Sauntra and Dr Sunil Gupta, but, still I am declined to take the lenient view and these kind of persons are to be hammered heavenly to be lodged in the jail for longer time so that they are unable to loot the others and disturb their sleep”.
With these observations, the Court awarded rigorous imprisonment for a period of seven years under Section 420 RPC and fine of Rs 1.5 lakh and rigorous imprisonment for 10 years under Section 467 RPC. However, both the sentences will run concurrently, the Court clarified.

M K Hanjura, Member J&K Sales Tax Tribunal, has been transferred and posted as Registrar Vigilance High Court. Pawan Dev Kotwal, Special Judge Anticorruption Jammu, has been transferred and posted as Registrar Judicial High Court, Jammu Wing.
Sanjeev Gupta Registrar Judicial High Court, Jammu Wing has been transferred and posted as Presiding Officer TADA/POTA Court Jammu. Sanjay Parihar, Sessions Judge TADA/POTA has been transferred and posted as Member J&K Sales Tax Tribunal.
Ashok Kumar Koul, Principal District and Sessions Judge Rajouri has been transferred and posted as Principal District and Sessions Judge Udhampur. Need to win people’s :GOC

VILGAM (KASHMIR), May 17:
Only killing the militants was “not enough” and there was a need to win hearts of the people in Jammu and Kashmir who will “end the militancy” in the times to come, army’s top commander in the Valley said today.
“The major lesson I go with from here is that it is not enough (only) to kill terrorists. Killing terrorists is not as important as winning hearts of the population,” General Officer Commanding of Srinagar-based 15 Corps Lt Gen Syed Ata Hasnain told reporters here, 110 kms from Srinagar.
Lt General Hasnain, who completes his term as the top commander of Army in the Valley this month, had laid a major thrust on winning the hearts of the people in Kashmir during his two-year tenure as Corps Commander.
The Army commander today held an ‘Awami Sunwayi’ (public hearing) at this village in north Kashmir’s Kupwara district where he listened to complaints and suggestions of people.
He said “in times to come”, it will not be the Army and police but people of Kashmir who will “end the militancy”.
Lt Gen Hasnain said so far this year “only one contact” has been established with the infiltrating militants.
“We have had only one contact, one operation on the Line of Control (LOC)…. Possibly some infiltration has taken place. Our grid on LOC is always porous,” the commander, who will be transferred to Army headquarters at Delhi, said.
He said the “threat of infiltration” by militants along the LOC increases during mid-June to mid-July, when snow on the high mountain passes melts.
The army commander said the army is on the borders because there is a “security threat”.
“If borders are made irrelevant, how can there be a security threat. The army is there because there is a security threat. It is a very good thing if you make borders irrelevant with peace and development,” he said. (PTI)

Jain’s deputation cleared, 3 shifted

SRINAGAR, May 17: State Government today cleared the deputation of Pramod Kumar Jain, Director General, J&K Institute of Management, Public Administration and Rural Development, to the Central Government.
According to the order issued by the General Administration Department, the services of Mr Jain have been placed at the disposal of Union Government for his appointment as Joint Secretary in the Ministry of Culture.
Sheikh Ejaz Iqbal, Commissioner Secretary ARI and Trainings Department will hold the charge of the Director General, J&K IMPA in addition to his own duties till further orders.
Meanwhile, Bashir Ahmad Wami, Executive Director, Rehabilitation Council, Social Welfare Department has been transferred and posted as Additional Secretary, Social Welfare Department.
Hafeeza Muzafar, who was under orders of repatriation in the Rural Development Department, has been transferred and posted as Executive Director, Rehabilitation Council, Social Welfare Department on deputation basis.
Vishal Sharma, who was recently appointed to the Time Scale of KAS and awaiting orders of adjustment in the General Administration Department, has been posted as Special Assistant to the Minister for Revenue, Relief and Rehabilitation with immediate effect.
